October 1, 2010 – Hamilton County, Iowa - In this intersection collision on Second Street in Webster City, Iowa we have an accident due to one of the driver’s not stopping for a stop sign. The result is one person died and several others were injured. The location is the intersection of D20 and R27 in Webster City, Iowa. A 2004 Chevrolet Venture Van driven by Mr. Arnold, 19 years-old and from Des Moines is driving northbound on Second Avenue and is approaching the intersection with D-20. In a 1993 Cadillac a 75-year-old driver, Larry Donahe from Webster City is heading in a westerly direction on D-20. From the police report the young driver failed to stop at the stop sign and t-boned the other car. It appears as though a passenger in the Donahe car was killed.Have you ever seen a car or truck rollover?

It’s going to be a long hot summer and while most high school graduates sit around waiting to start college they will certainly hand around with their friends and end up on those country roads looking for something to occupy their time. Today’s post is about uncontrolled intersections. The two boys in this story aren’t yet in college but joyriding is something boys waiting to head off to college might find interesting so I’ll add this to the Life on Campus section of the Lombardi Law Firm blog. Knowing or refreshing your memory about who has the right of way is a good idea.My Bad! I didn't see the motorcyclist! Too bad you lose.
Not seeing motorcycles is an often given excuse for having caused a crash with one. A proper lookout is a lookout that looks not just for the obvious, but also the less than obvious drivers, like motorcycles. As a driver you aren’t responsible for just what you saw, but for what was obviously there or that you can anticipate can be there and is lawfully using the city streets and roadways. In this instance the driver of the car is most likely the at-fault driver and can be held liable to the estate and dependents.Stopping at a stop sign isn't an option; failing to do so is 99% of the time negligence
Hancock County, Iowa: On July 29th 2009 a semi driven by Allen James Enabit was Northbound on R26 when he ran a stop sign and collided with the Toyota Celica driven by Amy Lynn Hefty who was Westbound on B55. Amy Hefty died as a result of the injuries suffered in the crash and Mr. Enabit was transported by Mayo Air Care to Mercy where he is currently listed in fair condition. The dependents of Ms. Hefty, if any would have a claim against the other driver and the owner of the Freightliner Semi that failed to stop.
It goes without saying that stop signs are meant to be obeyed; and for a very good reason. Fail to obey a stop sign and you are 99.99% of the time the “at fault” driver. So like most juries we ask, “What’s your excuse for not stopping?”
