What attorney is needed to sue a winterizing company?
Question Detail: We are doing a short sale on our house and we have moved out, so the bank hired a company to come winterize the property and take pictures. At this point we still have access to our house to finish cleaning everything out. Well the guy who came to winterize the property dumped a huge amount of garbage, he finally came forward and came back to pick it up. But prior to him cleaning it back up another guy came to take pictures and he had gone through everything in the house to see what there was. After all the garbage was cleaned up we went back to the house to clean out more of our stuff and found over $1,200 worth of our belongings missing. The only people to have access were the people from that company and us. There are n o signs of a break in so it had to be someone that had access. Cops are involved and are doing their part but what can we do on our end to this company who when notified did not even care that this had happened?
Answer: You need to hire an attorney that practices civil trial work.
Can I make his mother pay for my hospital bills and pain and suffering damages?
Question Detail: My sister's 17-year old boyfriend came to my father's house causing trouble. I live there with my father. My fiancé went out to tell him to leave and during that discussion he grabbed my fiancé and tried to pull him off the porch. My fiancé pushed him off and tried to come back inside. The 17-year old ran back into the house going after my fiancé. He then went outside and I went out to tell him to leave. At that point he punched me in the mouth and I had to get a stitch in my lip. This kid does this all the time to people, but they always drop the charges. I'm done letting him get away with these things. We did call the cops because my fiancé and I are both 23 years old. We will have a court date coming up sometime soon and I would like to know what I can ask for so I don't look stupid.
You won't ask for anything in a criminal case, except restitution. They will pay for medical bills and wage loss but probably not pain & suffering types of damages.
Answer: The criminal court can order restitution but pain and suffering damages is not a part of what they award in Iowa. You can get limited damages, like medical bills, wage loss and property damage, but the rest you’ll need to sue for in small claims court. As far as his mother paying, you’ll have to file a claim under her homeowner’s insurance policy.
Can I sue the guy who was drunk, ran into my parked car totaling it?
You can sue him and hopefully he has insurance to cover your damages. You'll do it in civil court, not criminal court. You can also submit a victim statement with your damages to the judge in the criminal case and the judge will likely order restitution.
What can we do if a personal property was damage by another party?
Question Detail: A person used my property and damaged it. We have no written agreement only verbal.
Does personal injury compensation include all medical expenses? I want to know whether it covers up not just the important operations but also medicines and post-surgery care.
Yes it does include past, present and future medical expense related to the injuries you suffered in the accident.
Will the hospital wait for my personal injury case to be settled? I do not have the money to pay for all medical expenses while staying at the hospital. Is there a way for the hospital to wait for my case to be settled?
Well the hospital won't want to wait; they will want to submit under your health insurance policy. There is no obligation for the hospital to wait but most will with an agreement for the attorney to pay them at the time of the settlement. But how much they want to be paid is always the sticking point.
How do I get full reimbursement for my loss? I have a pending auto property damage claim responsible party has insufficient limits what are my options responsible party has a $5k Property damage limit on a PA auto policy, my damages are in excess of $7K, how can I receive full reimbursement for my loss?
Well you get it from your own insurance policy or else you sue the other party for a deficiency. But don't settle with his company if you intend to sue him.
How do I compensate for my medical bills while my personal injury case is pending? I have to go through an operation because of a broken knee. My personal injury case is still pending and I do not have the means to pay for the entire operation.
If you have insurance then you get current payment on current medical treatment, but the defendant's insurance company is not required by law to pay as you go. See an attorney, because if you have a broken knee you'll have no way of knowing how to value this case.
