A potential employee that applied to drive trucks for Stevens Transport was not hired "per company policy," but now the U.S. Equal Employment Opportunity Commission has filed suit against the company for discriminating against the applicant. The company's "policy" that prevented their hiring of the applicant concerned the medication he was taking to control his bipolar disorder. The company doctor said that the applicant could not be hired while on the medication, despite documentation from his own doctor that said he was safe to drive. The applicant also passed the required DOT physical and advanced truck driver training. The EEOC says there are no regulations that prohibit people taking this specific medication from driving for a trucking company and that the company's refusal to hire is a violation of the Americans with Disabilities Act. They are seeking backpay, compensatory, and punitive damages.
