Van crash on I-80 is a lesson in post-accident investigation

The Iowa State Patrol is reporting a single car accident on I-80 involving a van colliding with a bridge abutment between Dexter and Stuart. It occurred in the eastbound lanes of travel and from last night's news it appears to have been preceded by the van hydroplaning on the rain covering the road's surface. No report has yet been issued so details are sketchy.

But there is one aspect of this crash that others can learn from it. A passenger who intends to file a claim against the driver needs to be able to prove fault. That means for the most part the vehicle must be preserved. Especially, like in this case, where the tire-tread may lead to a claim of failure to properly maintain. Tires with poor tread depth or mismatched treads are important to prove fault. If you let the vehicle be destroyed by insurance companies eager to destroy the evidence you lose.

In this case this is a family so there may be no claims asserted against the driver. But for other's who are unrelated to the driver preserving evidence is not just important or a good idea; it may be the only way to prove your case. People aren't going to like to hear this but right after the accident you need to hire a lawyer.
