Negligence can be attempting to pass at the cress of a hill.

A head on collision Monday April 6th led to the death of Patricia Ann Davis and Howard Jay Davis. Patricia was heading Westbound on 270th when she collided head on with a vehicle driven by Jonathan Jay Chumbley at the crest of the hill.

This is why you don’t attempt to pass on a two-lane highway as you’re approaching the cress of a hill. Unless you have x-ray vision you can’t see what is coming in the opposite direction and at 50 to 60 mph there won’t be enough time to correct and avoid the oncoming vehicle.  

Of course at this point until the ISP’s technical investigation is complete there is no guessing at who was trying to pass or what happened.
