In the comments section a person with the same name as Mahan indicates Tim Mahan was wearing his seatbelt. Is that to imply Chance Gunderson was not? We don't know. Facts, just one fact can change the way we view fault.

Officials said the driver was westbound on the gravel road when he came over the top of a hill at an excessive speed and lost control. The vehicle rolled several times, throwing the occupants outside.
