Madison County Accident raises a question: Can I totally rely on the State Trooper’s investigation?

The quick answer is “No, you should not.”

Trooper Ridout (one of the good guys) writes this description: VEH 1 AND 2 WERE BOTH NB ON BEVINGTON PARK ROAD WHEN VEH 2 STOPPED IN THE ROADWAY. VEH 2 REAR ENDED VEH 1. THE DRIVER OF VEH 1 EXITED HIS VEHICLE AND PROCEEDED BACK TO VEH 2. VEH 3 WAS SOUTHBOUND ON BEVINGTON PARK RD AND STRUCK VEHICLES 1 & 2 AND THE DRIVER OF VEH 1. According to the report Donald Ellis is driving an F-250 pickup [vehicle 1], Julie Brommel a 1998 Dodge Ram Pickup [vehicle 2] and Kathryn Jones a Ford Ranger pickup. [Vehicle 3]

This whole OWI thing is going get more complicated than anyone can realize because of the whole $150,000 automatic judgment when someone dies after someone dies in an accident involving a “motor vehicle” when someone was under the influence. The estate of that man, Donald Ellis (56 years old) needs to preserve the evidence in order to know what the facts were at the time. In fact everyone involved in this accident should. Ridout does a nice investigation, but he has limits based on what case he’s looking to prove. He’s looking to prove the criminal DUI case, not the civil case and that’s the point of today’s blog. Iowa State Troopers are not there for protecting your civil right to receive compensation; they are there to protect the state’s interest in criminal prosecution and the preservation of property. So yes, even though Trooper Ridout does a great job of investigating don’t assume he can do more for you or your case. He’s doing this job properly, but you’re not his client so never make that assumption.
