Failure to Control Causes Crash South of Brandon, Iowa

It's what lawyers refer to as a failure to control case. In a car accident south of Brandon, South Dakota a car is reported to have lost control rounding a curve, gone off Highway 15 and striking a tree near 481 st Avene and 268th Street, just over the Iowa border.   The first thought has to be speed, the second questions whether the driver was drinking and the third a distracted driver. Legally speaking, it all adds up to a failure to maintain control, driving with excessive speed and a failure to drive using due car and a proper lookout. You have one person heading off the hospital by a helicopter and the other taken by ground ambulance.   Slow down, keep looking out the windshield and put the cell phones away. It's really that simple.
