Deposition don’ts – What you shouldn’t forget to do before your deposition.
1. Don’t allow your clothes to be or become a distraction.
2. Don’t volunteer information.
3. Don’t be overly friendly.
4. Don’t answer before you think about the question asked.
5. Don’t allow the speed of the question to dictate the speed with which you answer the question.
6. Don’t argue; you’re not there to argue; only to answer questions.
7. Don’t forget to relax; if you need to use the restroom or get a drink ask.
8. Don’t answer the question without listening and pausing.
9. Don’t forget to hide those tattoos.
10. Don’t forget to dress conservatively.
11. Don’t forget no matter how nice he/she may act, that the opponent’s attorney is not your friend.
12. Don’t forget to listen to your attorney and to follow his/her directions.
13. Don’t forget to get a good night sleep the night before the deposition.
14. Don’t forget to drink plenty of water the day before.
15. Don’t forget no drinking the night before the deposition.
16. Don’t forget to read your answers to interrogatories the week before the deposition.
17. Don’t forget to read the accident report the week before the depositions.
18. Don’t forget to make an appointment with your attorney for a pre-deposition conference the week before the deposition.
19. Don’t forget to review the medical dateline your lawyer should have prepared for you.
20. Don’t forget to review the Petition and Answer in your case before the deposition.
21. Don’t wait till the last minute to get prepared for your deposition.
22. Don’t allow the attorney you’ve hired to ruin your chances of winning. If they aren’t doing their job don’t stay with them; fire them before the deposition and hire another one.
23. Don’t be foolishly loyal.
24. Don’t think you can be prepared to testify at a deposition without preparation.
25. Don’t let your attorney fool you into thinking it’s enough to just tell the truth. That’s not preparation.
