  • Quasi-criminal Acts Excluded from Workers' Compensation [PDF]
Description: I’ve uploaded the decision onto my website because I find it both interesting and a sign of the times. If you wish to read this interesting decision about an exclusion when intentional acts are considered to be of a quasi-criminal nature that are likely to result in serious injury, then follow this link. The basis of the decision is arising out of the course of the employment.
  • Horesplay and Work Related Injuries - Work Comp in Iowa [PDF]
Description: There is a news item out of the Business Insurance site discussing the “horseplay doctrine” in the context of a restaurant worker suffering a shoulder injury caused when he raised his arm for protection from ice being thrown by a co-employee. I actually disagree with the characterization that raising one’s arm can cause this injury.
  • Injury while bowling at an office event, is it compensable? [PDF]
Description: The Iowa Court of Appeals in Gazette Communications, Inc. v. Powell, No. 0-633/10-0017 (Iowa Ct. App. 10/06/10) determined that a bowling outing arranged by the employer’s employee activity committee was not compensable under the Iowa Workers’ Compensation Act, Chapter 85. This case is like a good boxing match between two heavy weight fighters slugging it out round by round and no one every appears to have the fight in their control.
  • Employees who are killed or injured from lighting while at work [PDF]
Description: Employees who are killed or injured from lighting while at work would be covered under Iowa’s workers’ compensation program. There is no indication in this news story whether or not this employee’s widow or dependent children would be covered. Laws vary from state to state and workers’ compensation programs differ greatly. The reason why there is coverage has to do with the work exposing the employee to special risks or hazards of the particular employment. In this instance a ranch hand is exposed to risks associated with inclement weather, animals and other environmental exposures. The employer benefits from the employees working under such conditions and is better able to spread the cost of such risks to customers.
  • Workers' Compensation - Chemicals In the Workplace - Sodium Hydroxide
Description: Chemicals in the workplace are an often times ignored risk of injury and death. Here is a start of what to look for in your place of work. A recent tragedy at a Mason City hospital made us think about adding it to our own site for workers to learn more about the risks in their work places.
  • Worker Safety in Iowa - Sodium Hydroxide [PDF]
Description: Sodium Hydroxide - Chemicals used or occurring in electronics manufacturing are listed here under general groups. This chemical groups list can be used (1) to identify specific names of chemicals, and (2) to group chemicals generally according to use and type of hazard. For example, you are using certain acids, but are not sure what specific kinds. The group list for acids provides specific names which may help you to identify the acids you are using.
  • What are PCB's? [PDF]
Description: PCB's or polychlorinated biphenyls (PCBs) are man-made organic compounds that can be found in capacitors, transformers, electric motors, oil-based paint, plastics, insulation material, pumps, and pipes. PCBs have been used in literally hundreds of industrial and commercial applications.

Description: Did you know that each year over 30,000 crashes involve SMV’s? This may actually be the problem. It will be interesting to see if the Trooper or Sheriff’s deputy’s investigation uncovers this fact.
  • Driver Safety: Does snow and ice on the road excuse the driver’s negligence?
Description: Officer Daniel notes major contributing circumstances include the roadway’s weather condition, the road surface condition and the first event is that the Palen vehicle crossed the center line. Let’s assume this to be the case. There are four factors to take into consideration.

    1. There is a snow storm.
    2. The roadway has snow and ice.
    3. Palen crosses the center line.
    4. Palen’s speed is fast enough for the weather conditions that the tires of her vehicle lose friction allowing the vehicle to slide out of control.

The first question you have to ask yourself is at what point a person simply has to not leave the house, waits to drive on the roads, if already on the roadway to pull off of the roadway and wait for the weather to clear sufficiently that travel is once again safe.

Iowa is a comparative fault state. What is fault as the law defines it? Fault is one or more omissions towards the person or property of the actor or of another which constitutes negligence or recklessness. It could mean misuse of a product, unreasonable failure to avoid an injury or unreasonable failure to mitigate damages. Iowa Code 668.1.

  • Auto Safety: Why do car and motorcycle accident cases take so long to conclude? [PDF]
Description: Why do lawsuits take so long to conclude? That’s a question you may have asked before. Perhaps you’ve sat around the local diner complaining about the weather and as often will happen sooner or later the conversation turns to the lawyers or court system. Well let us explore the answer to that question in this White Paper offered by Steve Lombardi, Lombardi Law Firm.
  • Driver Safety: Starts before you turn the ignition key, by Steve Lombardi [PDF]
Description: Tractor trailer drivers recommend that, when cars have to share the road with big trucks, the car drivers follow a few simple rules: don’t cut off the tractor trailer, since big trucks require a lot more room than cars to stop; be courteous and don’t try to race past a truck with its blinkers on; don’t drive alongside the truck, especially if you run the risk of disappearing in the truck driver’s blind spot. Although most accidents are caused by the commercial driver, a significant number of these accidents occur because driving a truck makes it difficult to fully see the surroundings and because many passenger vehicle drivers fail to respect the truck’s right to drive on the roads. Remember being courteous is a two-way street.

  • November 28, 2010 Montgomery County Crash - Passing at Hill's Crest [PDF]
Description: Two adults were injured and two children died after the car they were passengers in hit a semi-truck head-on at the crest of a hill. The oncoming driver, Nina McNeese driving a 2001 Kia appears to have no fault in this one. You never attempt to pass at the crest of a hill, even if it is marked as a pass zone; which in this case the Iowa State Patrol indicates it was not. Description: Food Safety, how do you prove you have salmonella poisoning? If you have the symptoms of food poisoning you first need to obtain proper medical care. The doctor will need to diagnose food poisoning by a blood and stool test. Those tests are very important later to proving a case. Without blood and stool test that show the presence of Salmonella it is only your testimony describing symptoms; and that won’t be enough to carry the case of liability.

Description: Is Cheerleading A Sport? The legal answer might surprise you. Since the Title IX trial of Quinnipiac University regarding the volleyball team being cut, elevating the stunt and tumble team to Varsity status a plethora of information has been thrown at the cheerleaders, parents and coaches.
The official position of the National Cheer Safety Foundation’s Panel of Experts since it’s creation in 2009 has always been that the skill sets of stunts and tumbling in cheerleading were a discipline of gymnastics and that those elements must be approached from a sport coaching perspective as a matter of safety.
To help clarify any cheer industry confusions, here are some easy definitions of the different forms of cheerleading.

  • F.A.C.E. Investigation Report for maintenance worker struck by hose nozzle. [PDF]
Description: In this case a groundskeeper and municipal maintenance worker was killed when struck with the steel coupling of an out-of-control high pressure nozzle/nossle. SUMMARY
    On June 27, 1996 a 62 year-old senior grounds keeper/maintenance worker was killed when a
high pressure water hose went out of control. A crew of workers was using a plunger pump
sewer cleaner to attempt to blast water into a hole to deepen it for installation of a new light pole.
The victim died when he was struck on the head by the steel coupling of the hose. Three other
workers were injured. New Jersey FACE investigators concluded that, in order to prevent similar
incidents, the following safety guidelines should be followed:
o Equipment should be used only for the purpose for which it was designed.
o Employers should implement a comprehensive safety training program.
o Employers should conduct a job hazard analysis to identify and correct potential hazards.

Description: wrong-site, wrong-procedure, wrong-patient, surgery, time-out, pre-surg, surgical, team, Doctors have reported that a simple checklist of procedures to be under taken and other such basics can halve the rate of surgery related deaths. The World Health Organization team reported the checklist procedure was similar to the one pilots used before every flight and this simple and inexpensive addition could also cut the complication rate post surgery.

"Using a surgery checklist designed for safety cut the complication and death rate by a more than a third," said lead researcher Dr. Atul Gawande, an associate professor of health policy and management at the Harvard School of Public Health and a surgeon at Brigham and Woman's Hospital, Boston. "The safety of surgery has now become a major public health concern."

The report was published in the Jan. 14 online edition of the New England Journal of Medicine. In the study Gawande's team collected data on 7,688 patients across hospitals in Seattle; Toronto; London; Auckland, New Zealand; Amman, Jordan; New Delhi, India; Manila, Philippines; and Ifakara, Tanzania.

  • Free Smoke Detector Installation by the Iowa Fire Marshall's Office [PDF]
Description: Yes you read that right; you can get up to two free smoke detectors installed by the Iowa Fire Marshall’s office in a residence in Iowa. That’s a pretty sweet deal. How can you go wrong? You can’t so get off your fanny and contact them. The only requirement is that a child younger than junior high live there.

WHY IS A WORKING SMOKE DETECTOR VITALLY IMPORTANT TO YOUR FAMILY'S SAFETY?

There is always a delay from the time the fire starts until the fire fighters arrive. Obviously the quicker your family receives a warning the sooner they can get safely out of the burning house. That means you need some system in place for an early warning. The significance of operable smoke detectors should be clear. Yes? No? If no, then go back and reread what I just wrote.

  • Summary of Legal Rules Governing Liability for Recreational Use of School Facilities [PDF]

We provide a summary link to legal rules or the laws allowing the avoidance of responsibility for running a dysfunctional swimming pool program.
  • Iowa’s Deficient Bridges - 2008 Report [PDF]
Description: Do you ever wonder about the safety of driving over a bridge in Iowa? If you knew the state of disrepair of our infrastructure it might scare you to do something when state officials waste state resources rather than commit those resources to repairs, replacement and maintenance.
  • Iowa Fire Deaths: Landlords, Tenants and Homeowners – Get your act together.

  • Iowa Fire Deaths: Landlords, Tenants and Homeowners – Get your act together. [PDF]
Description: House and building fires in Iowa have killed 19 people since January 1, 2009. Four more people died just this past week. During all of 2008 there were just nine. In 2007 there were 30 and 2006 33 fire related deaths in the State of Iowa.

  • Where Sperm, Science and In Vitro meet the Social Insecurity Act [PDF]
Description: A few years ago I wrote a post about the social security benefits case involving a child born by in-vitro fertilization following the father’s untimely death. Apparently the father died of cancer, but before dying they froze his sperm and after his death the mother of the child was inseminated, gave birth and thereafter filed with the Social Security Administration for dependent death benefits.
  • Varnum vs Brien, 763 N.W.2d 862 (Iowa 2009) [PDF]
Description: With the Election Day looming we are in the home stretch of the run to either retain or to remove three of Iowa’s Supreme Court justices from office. It all stems from the Court’s decision in Varnum vs Brien. Really it’s much to-do about nothing because Varnum is the gay marriage decision the Court handed down and the controversy has turned to the opponents taking this opportunity to try and make the judiciary less independent and more like a monarchy. Every homophobe is crawling out from under a rock and shouting about “How dare they decide in a way I object!” With the economy being in the crapper the politicians’ love this kind of a distraction because while the kids are fighting in the sandbox no one is watching the money they are wasting on senseless projects. So let’s walk our way up to this Election Day with the score card and menu so we can get beyond it and either retain sanity or throw it out in favor of a monarchy.

  • WRONGFUL CONVICTIONS OF OWI IN IOWA
Description: You are innocent and charged with OWI. You should either get a dismissal of the charge before a trial, or a unanimous jury verdict at trial of “not guilty” which in legal terms is called an acquittal. I’ve had jury acquittals on breath tests as high as .185, which is more than twice the legal limit, and on breath tests as low as .06, which is less than the legal limit of .08. Yes, sometimes prosecutors will file an OWI charge even if you blow less than .08.

Description: What five things should you not do upon being stopped? Know your rights and how not to make matters worse for yourself. Today we level the playing field.
  • Teenage drinking - What is a lethal limit of alcohol? Having an action plan.
Description: How do you know when your friend has had a lethal dose of alcohol? Scientists use the term "lethal dose" (LD) to describe the dose (or in the case of alcohol, the concentration) that produces death in half the population (LD:50). Most authorities agree that blood alcohol concentrations in the 0.40 - 0.50% range meet the requirements for the LD:50. The blood alcohol concentration is the percentage of alcohol in the blood that results after alcohol is absorbed from the stomach into the blood supply. Obviously, studies of lethal dosage cannot be tested empirically in the laboratory, so the LD:50 for alcohol is estimated from post-mortem cases in which alcohol poisoning was found to be the primary cause of death.

  • THE JOB OF YOUNG LAWYERS IS AN INTERESTING LEARNING EXPERIENCE

All though Mr. Mccloud was wearing his seatbelt he died from the injuries sustained in the crash. The point of contact was broadside on the driver’s door.
For young lawyers and would-be trial lawyers these single-car accidents can be a useful exercise in how to investigate an mva. In this instance there are many questions with no answers need to be asked. What would you want to know?

  • InBrief: Medical Billing Tricks of the Trade Part 1 [PDF]
Description: The relationship of hospital and patient operates for the most part on trust. We tend to believe in that same trust when paying the bill. But is that trust deserved? Is the hospital taking advantage of that trust? Over the past several decades the landscape has changed in the medical profession. No longer is the hospital business office part of a kind and caring religious institution. Hospitals look less and less like benevolent not-for-profit institutions and more like well-heeled business machinery.

  • Libel/Slander Immunity - Physicans - Medical Examiner - Standards of Care and Practice [PDF]
Description: According to a Des Moines Register article libel suit between the Woodbury County Medical Examiner [ME] and a surgeon he reported to the Iowa Board of Medical Examiners was ‘tossed’ by Judge Reade. But I don’t think that’s completely accurate. I believe the suit is still alive although portions of it have been ruled upon in a way that is adverse to the plaintiff, but favorable to the defendant. The ME reported a doctor for what he thought was standard of care issues. I’ve not completely read the decision but will guess the main issues were immunity from suit. Okay, I’ve located the opinion and I’ll add this link and add the decision to my site under defamation. The Order is 40 pages long. I can see both sides of this argument. On the one side you have the ME’s role as a government official and medical doctor protecting citizen patients. On the other side you have a doctor spending a considerable amount of money, $200,000, defending himself. No one will be happy with this controversy.

FAQs

Car-Truck-Cycle Damage Q&A's

Who is responsible for the accident if we hired a company to transport a consultant? We were hired by a private company to transport their IT consultant. A vehicle from us was accidentally smashed by a truck and my pick up vehicle is a total wreck. One passenger is dead. Now I want to know who will pay for the hospitalization of the driver? Is it the company who hired us? Or the owner of the pick up vehicle?

The insuance company wants to take a recorded statement, is there any reason why I shouldn't or what should I be on the lookout for?

If I have a 5th wheel trailer can I pull a boat behind with a ball hitch?

Workers' Compensation

What can I do if I was hurt at work and my employer has not helped me yet? I got hurt at work over a month ago and I am in need to get a MRI and the company keeps putting it off. They did not turn it in to workman's compensation and I need to see what's wrong. I am having a lot of pain. What can I do?

What can I do if worker's compensation won't communicate with my attorney? I slipped and fell at work on the school bus steps. I hurt my back and the xray and MRI says I'm fine but I can't function and I am in constant pain. The doctor says I have lower lumbar pain and my left sciatic nerve is giving me problems. I went to physical therapy but workers comp only approved 12 visits. I have a list of restrictions. Workers compensation won't approve my 2nd opinion on my back and won't approve any more therapy and they just started pay me but they are under paying me. On January 13th, I would have been off work for 3 months. I have an 11 month old child and due to non payment from workers comp I lost my apartment and my lights and water got cut off. I had to pull my child out of daycare. My job won’t let my come back unless I am free from restrictions and free from doctors’ care. If I do a settlement case with my job and workers comp how much do you think I'll get? Because I am so far in debt and now I have to go to court over the apartment I just lost. and yes i do have a lawyer but it seems as if he can’t do anything either. workers comp wont communicate with him or email back they won’t correct my amount or back pay me so I'm like what do I have a lawyer for again?

Can I sue my employer if I was injured at work after several months?  I got hurt while working at a company. They treated me for tendinitis and kept me working under lifting restrictions. Seven months later they found an almost 2 inch tear in my rotater cuff. I had surgery then physical therapy for 5 months. After about 3 months of progress at PT I started having severe pain. I returned to the doctor and was put on an anti-inflammatory. I am still currently taking them. A few months prior to having or even knowing about the surgery, I had plans to move closer to family. I had asked my job if my injury would affect my transfer, I was told 'no not at all' they even helped me put in the transfer request. I recently made the move from Pennsylvania to Nebraska. I am now being told that I am non-transferable. I have been with this company for over 3 years, had an excellent annual evaluation, and did everything they asked up until the move. Due to the continuous inflammation and pain, I'm unable to do previous jobs or personal tasks. Do I have a case? Could I sue for continued medical care or a settlement?

Can I sue for my account being banned due to using another account that violated the TOU? After playing a game with another account that had violated the TOU, my account that has done nothing wrong was banned from the service, there was no warning, or even notification of a ban. Would I be able to make a case for a suit, or are there no laws on digital services? I have tried to contact the developer, as well as another software company, but they refuse to do anything about it.

Can I sue for personal injury if my brother was severely injured in a group home? My brother, a required 24 hour supervision disabled person, was under a care of a group home over the past weekend. However, they weren't watching him closely and according to the group home manager, my brother broke his leg and injured his neck while opening the door. From the looks and required treatment, doesn't look like this is what happened. My brother had to be put under and undergo surgery on his leg. I want to know what we can do legally.

Can a minor collect a settlement from a car accident? My son was under 18, and was in a car accident. Now that we are settling, he is now 18. Should the check be written to me or my son being that he was under 18 when it all happened?

I-35 I-80 I-235 I-380 Collisions/Accidents

What should I do if an attorney is trying to overcharge me for an auto accident case? On July 2010 I was rear ended while on duty. That day I was transported to the hospital and scheduled a follow-up with the workers comp doctors. Upon several visits the doctor advised that neck and hip pain were pre-existing, so I decided to get a Lawyer. I went to Lawyer A, who has represented me up until Nov 2011. On November 19, I received an email from Lawyer A, who advised me the insurance company wants to settle my case for $12,500 with me receiving $5,000. I advised Lawyer A that price would not work, because I have been seeking treatments (message therapy, and acupuncture) using my personal insurance. I did not know when I was using my personal insurance, depending on how the treating doctor codes it, the insurance company can seek for me to pay them back in the future (information told to me by Lawyer A’s staff) . In addition, Lawyer A’s staff advised me to not go back to my worker’s comp doctor because my bill was too high, and for me to see a personal injury and car accident doctor. When I advised Lawyer A that did not want to settle my case with the insurance company for $12,500 with me receiving $5,000, Lawyer A offered me $6,000. I advised Lawyer A that price would not work as well and I would contact their office at a later date. I then found Lawyer B, explained the entire situation to them and signed an agreement with them and terminated Lawyer A due to me not being satisfied with the services they provided me throughout the entire time. Almost a month later Lawyer B contacted me advising me that I was untruthful and they are deciding to not take my case because per the insurance company Lawyer A settled my case for $12,500 on November 19th, and a check was already overnight to Lawyer A’s office. Now that was unbeknownst to me. I then contacted Lawyer A and their staff advised me the insurance company was in a rush and just mailed them a settlement check in attempts to clear their books before the end of the year.

Can I sue the policy holder for injuries or just the driver? I was in an accident and the other driver was at fault. He is a high school senior. The insurance policy is in a different name but same address. If the limits are low, can I sue the policy holder or just the driver? I was injured and have had two surgeries. The doctor says I will likely need more.

Do I have a case against the car manufacturer for airbags that did not deploy? I was in a accident where my vehicle was struck in the rear, my passenger side air bag deployed and the driver’s side air bag did not. I had nothing sitting in the seat on the passenger side of the vehicle. I was going 60 MPH when I was struck by a vehicle going 95+. My vehicle then struck the dividing barrier on the driver’s side. (Referring to 2nd generation air bags)

How long should I want to hear back from an adjuster for a claim?  I was in an automobile collision where I was not at fault in Aug 2010. I suffered a broken foot where I needed surgery. The adjuster was very nice and indicated he wanted to get this settled quickly. He said I needed to wait until the doctor released me from care before he could settle the claim. In June 20, 2011, I sent him a letter with a packet of photos, copies of medical bills, pay stubs, explanation of the collision, etc. I also told him I expected to hear back from him 30 days from the date of the letter. On July 20th, 2011, He left a phone message saying he needed to get the medical bills directly from the facilities and needed to contact my health insurance for a lien (since they paid for most of my care). That was the last time I heard from him. It is now Jan 24, 2012 - over 6 months later. I did some research and found that the statute of limitations for personal injury is 6 months from now (2 years after the collision). Is waiting 6+ months to hear back from the adjuster as he collects this information Bad Faith?

Is it a valid excuse that my tire dropped off the shoulder just before I overcorrected, lost control and went over the center line, where the accident happened?

What can I do if I was involved in a car accident with no insurance? On Dec. 17th, I broke my pelvis when a car hit my car head-on. I was turning left at a green light, as though it were a green arrow in a moment of mental lapse. The truck was full speed as the light changed, as he was anticipating it as he approached. I have no insurance, and my plates were expired since I am unemployed, a single mom, and was waiting until after Xmas to take care of these expenses. I was dumb, I know, but what happens now? Am I going to be sued? How is fault determined in this case? Note: his 2003 Ford was also totaled by insurance, but he was uninjured.

Can a child be sued when he shoots another hunter?

Do I have to cover someone's medical bills if I accidentally caused an injury? The guys hand was broke now we have to pay for the surgery and everything else. I offered that day to take him to get his hand x-rayed. He declined and then two days later took himself to the ER and found out it was broken then had to have surgery to put pins in it. I offered to help pay and have paid him $300 so far. Now his next bill he wants me to pay is $1030 and that doesn't included surgery bills yet. He said he will sue me if I don't pay all of his bills. Work-Comp For Doctors!

If my employer is filing for bankruptcy, can they still be liable if I was injured? I got hurt while in the workplace. What can I do?

I'm a doctor and we get a lot of referral work from this one workers' compensation insurance company, but frankly it bothers me how controlling the adjusters are in these case. It seems to me they think referring us work is leverage to sway my opinions on causation, permanency ratings and work restrictions. I think my opinions should be independent and without bias from the benefits of our referral relationship. What can I do?

ATV, Bike & Motorcycle Accidents

Is there anything I can do to settle my health problems after an accident? Hit by car on bike, no treatment, and no police. Now shoulder hurts any recourse? This is not a hit and run, he paid for the damage to my bike, and I agreed he could do it out of pocket because it was less than his deductible and I thought I was fine. That night he gave me a ride home and did admit he did not look my way. He also loaned me a wheel for my bike which I did not use. He paid me with a check for the damage. I have pictures of my bike and his truck (license plate yes but a bit fuzzy) from the night. I have his name, address, phone number, and place of employment, and receipts from my bike repair. I will feel bad about renegotiating our agreement but my health is at stake. Is there anything I can do?

They told me to seek more doctor approval, but I have no insurance then they said they could do a claim for future medical expenses but they have been waiting on my medical bills for over 4 months. This happened in September. I'm still experiencing numbness in my right leg along with tingling back pains and headaches. These sometimes hinder my everyday tasks like my job.

Client Trial-Deposition Preparation

I have a quick question on depositions--I have read all your information.  I need to know if the opposing attorneys can make me give another deposition.  Three attorneys were present during my deposition, and the fourth "couldn't be there" and cancelled the first depo.  Then 3 months later, the depo went as planned, fourth attorney not showing up.  Now, a year later, the fourth attorney wants to take a depo. I say no, he can refer to the original depo for answers, I feel he is trying to trick me into something.  He has all the discovery --and copies of the depo--what is he up to???  Thanks for your help.

Can I sue the drunk driver that caused me neck and back pain? I was rear ended by a drunk driver in November 2010. His insurance company outsourced the claim to a company that specializes in these sort of cases. I got a little money from his insurance, but not enough to cover all of my loss and expenses. Is it too late to sue? Would it even be worth it? I took the ambulance ride to the hospital to get checked out. They didn't find anything wrong. A couple of days later I had significant neck and back pain, saw a chiropractor. I still have neck and back pain that I did not have before the accident. I was a delivery driver on a delivery. I was unable to deliver after the accident.
