I'm never sure of how to answer this question. Judges tell me this system isn't about fairness, that fairness is nothing more than a side product. I can't agree with that statement because I'm looking at this system from philosophical standpoint, not an administrative one. Judges in my mind should not be administrators in black robes. I believe judges should be more like ambassadors of the court system making sure people are treated fairly  and  that fairness should prevail in the end result.

To answer your question, no you won't be treated "fairly"; not as most people view the concept of fairness. Fairness depends on what side of the case you sit. It shouldn't but according to most people's idea of what is fair, that is how they think about the concept. They will say treat me fairly, but what most really mean is help me to win and I'll agree the system was fair. Treated fairly to a judge means the system treated you just as it has treated others who, like you, have sat before the court or the industrial commission. Fairness to them has nothing to do with which way the case is decided, only that the rules and law were applied as expected. Fairness to everyone means no one lied, but fairness does not dictate an outcome. It is in that regard that the concept of fairness divides along a path less travelled.

After a worker is injured is when they need the support of their employer the most. But injured workers aren't given a level playing field.
