Yes it will. You will likely lose the right to control the law suit and the negotiations. Filing for bankruptcy during the pendency of a personal injury claim will likely lead to the bankruptcy trustee taking over the case. Normally they will work out a new fee agreement with your attorney that allows you the injured person less than 1/3 of the settlement. Because the lawyer will have to advance expenses and have no recourse to recover expenses in the event the case goes south, they will be want a higher percentage; probably 40% of the recovery, plus expenses with the remainder being split evenly between the trustee and the injured party. Yeah I know you don't like this, but face facts this is a business and we too have a gas and electric bill to pay.
