Who is responsible if my son get injured by a sliding glass door at the hospital? I work for a hospital in which my insurance is through, I have three kids, my middle child had a doctors appointment with a practice that is in one of the hospital owned buildings. After the appointment me and all three children go to leave and a nurse is outside that helped us, so I talked to her, at the moment the sliding glass door opens and sucks my youngest (he's 2) arm behind the wall which he of course starts screaming. The nurse and I then began to try and break the door to unpin my son. After about a minute we get him out and he's screaming bloody murder. We rush back into the office of where she flies us in to the room and is yelling for the doctor to rush out. My son is uncontrollable and won't stop screaming for an exam, so the doctor says by the way he's moving it, it seems ok. 10 days after I get a bill in the mail for my copayment, so I called the doctors office to say it was the doors fault but they said there is nothing they can do. So I called the insurance and filed an appeal to which it was denied? Am I really responsible for the door sucking in my child?

Who is responsible can be a very complicated problem, but as for you and your health insurance, the co-pay is your responsibility. If you file a claim against the hospital the hospital's liability insurer may be able to pay the entire medical bill under the medical pay coverage. That is more than likely the answer to your immediate problem. Write a letter to the hospital's loss-prevention department inquire about the hospital's property insurance covering the medical bill.
