This is an interesting product liability case. But it's too complex to address in this format. Save the phone, collect your medical records and bills then see an attorney. Call my office if I can help. The phone will need to be examined by an expert.

What rights do I have when my cell phone burned me? The first phone I had has over heating problems and then my phone went black. I emailed sprint and HTC about this problem. I got another phone from the same maker in the mail. On Nov 4, 2011 my cell phone burned me. I emailed the company and sent pictures of the burn. Also, my son has autism; he is 5 years old and doesn't speak. On my phone he uses an application called "Easy Kid Tokens". He went to grab for my phone and he put it down really fast. I went to go touch the phone. It was hot but it didn't burn him. I received a call from the corporate office. She informed me that I would have to return my phone to them to see how hot it gets. She said if it's normal, she will return it back to me. I told her I didn't want this phone anymore. This is the second phone I had. It takes the phone one time to burn me and it did. I want to know what should I do? What rights do I have about this issue?
