Q:

Was injured at work, can my employer take away my vacation hours banked up while I am on workers comp awaiting surgery for a broken heel for payments for health insurance plan?

A: No. If your claim is a valid and legal workers' compensation claim as you've described with the limited facts; then you're entitled to benefits. Of course the legal question is were you actually injured at work and does the insurance company have a valid defense? And that's the rub.

After a worker is injured is when they need the support of their employer the most. But injured workers aren't given a level playing field. The company doctor often times is not helping them and the case manager isn't either. The worker is left alone to fend for themselves and to make mistakes that result in lower benefits or fewer weeks of benefits. Some are sent back to work too soon. There is only one person on your side and that understands this system.
