That question is not easily answered without first reviewing the films and treatment notes. The question that must first be answered is whether what the chiropractor did in treatment either fractured the vertebra or exacerbated the already degenerated spinal condition that it caused additional damage. The answer to that question will require a doctor's opinion. Many times neurologists will tell the patient privately their opinions but then refuse to get involved with the legal process. Unfortunately that makes the case both expensive and increases the risk of losing before a jury. Medical malpractice involving chiropractors isn't as difficult as some cases, but winning is still a challenge. So the answer to your question depends on the help of the neurologist. Call our office if you need a referral in Iowa.

Should I file a malpractice personal injury lawsuit? Is there a limit to file for malpractice? I am now disabled because of a chiropractor. He has been sued and he lost before. He told me my back was fine, mild arthritic changes. I have all his notes, x-rays and MRIs. I'm still technically under his care as I still owe him money over and above what my insurance paid. I have info from 3 Neurologists that one disc is fractured in two places, 3 herniated disc, two bulging disc, stenosis, and multiple bone spur meant that I should NEVER have been touched by a chiropractor (I have this on tape). I went merrily along not knowing I had a bad back. Until I strained my back and became paralyzed with pain and had to be hospitalized. My current medications to just walk carefully are: Fentanyl, Vicoden, Flexeril, Valium, 4 back injections and compazine for nausea etc.
