Generally speaking no, but there isn't enough of a description to know what advice to give. This question requires a more complete fact description to be able to answer it. For instance, a sudden action on the part of the passenger is different than is something planned between the passenger and driver. If the behavior is something the driver takes part in then the driver can be responsible. Knowing what advice to give is specific to the facts of the situation. In other words, accident specific.
