Q: I'm a truck driver and was injured in an accident. After seeing the doctor I was told to rest for 7 days, see my doctor and then have therapy. The employer is having me stay in a motel to recover. I'm from Fl and the company is in Iowa, can they do this?
A: Not only do I know which company it is I know where you're staying. That's how common this practice has become with this one trucking company. The idea behind it is to make you quit. It's never been tested but no they can't make you stay in a cheap motel and call it a workers compensation hospital; I doubt the commission would support it. My understanding is you have a very limited environment there and it's your basic cheap motel atmosphere. Are you a married man? Children? You need to develop the reasons why you need to be home. Are you eating out of a vending machine? Call me today if you need to rant. I'll be in the office after 8:00 a.m..
After a worker is injured is when they need the support of their employer the most. But injured workers aren't given a level playing field. The company doctor often times is not helping them and the case manager isn't either. The worker is left alone to fend for themselves and to make mistakes that result in lower benefits or fewer weeks of benefits. Some are sent back to work too soon. There is only one person on your side and that understands this system. If your lawyer doesn't understand the nature of this claim you've got the wrong lawyer.
