Q: Can I sue the employer personally if he does not carry workers compensation? This is an 8 company (multi~state) waste corp. I was injured and have been off on medical leave since 8/09. He does pay weekly benefits, but those are his random checks that randomly bounced for no reason. I also have aflac, payroll deduct, but couldn't file full claim because he stopped paying.
For good advice see a lawyer and if you have questions about this blog, the law or your case write or call me directly. Steve Lombardi, sdlombardi@aol.com and 515-222-1110. I handle all types of personal injury cases including car accidents, truck accidents, motorcycle accidents, workers' compensation cases. We help truckers all across the country who come through Iowa and end up in an accident. If we need other lawyers from other states we hire them and it costs you no more than what you would pay us; in other words, we split the fee between us. We also handle other civil types of cases and do defend when called upon. After all I am a lawyer. So call 515-222-1110 or email us at sdlombardi@aol.com.

This is a mess and one that a lawyer is necessary to correct. You need a lawyer who understands workers' compensation law in Iowa. We've practiced in this area for 30 years so if we can help you let us know. If not us, then find one in your area that is competent. Good luck if I don't hear from you.
