Yes you can still "collect on a personal injury accident."; although I'd refrain from using that terminology. It makes you seem, well... unseemly. It sounds like you have a good case. A person can still be at fault in a civil court even though they violated no criminal law or there is insufficient evidence to find they violated a traffic law.
