Quasi Criminal Acts Excluded from the Illinois Workers' Compensation Act
We have several worker injury cases to discuss today but right now I want to focus on only one. This one involves an Illinois State Trooper involved in a car accident on November 23, 2007 that resulted in a double fatality; he was talking on his phone at some point; although from the decision it isn’t entirely clear when in the sequence of events. I for one would have never guessed he would be denied benefits. I contacted my friend and colleague Nick Avgerinos who practices in the area of Illinois Workers Compensation to ask what he thought of the result. When does workers' comp start paying? or When should workers' comp start paying? These are two rather interesting questions that should, but don't have a simple answer. Let's try and answer the second one first. Injured workers should start getting paid after they are out of work for 3 or more days following a work related injury. If you're out of work for 10 days or more then they are supposed to catch you up and pay those 3 initial days off of work.Category: Workers' Compensation
2-25-2011: What are Common about a PTO Shaft and a Woman Scorned?
The question asked this week is: what is a PTO, a power take off shaft and what does it do? A PTO is a power takeoff shaft commonly found on tractors and used to transfer power to that piece of motor-less equipment. (See also universal joints.) Farm implements that standalone, like augers and other types of grain lifts need power to turn the gears and conveyor mechanism; that power is provided by a tractor’s power take off hookup. The shaft is a separate piece of equipment that hooks into the rear of the tractor and then into the implement, in this case the auger. It turns and like a driver shaft as it turns the power turns gears or wheels that power the implement and make it useful for work.Category: Workers' Compensation
How do I select (pick) a workers’ compensation attorney in Iowa?
I’m not sure exactly how to answer this question without indicating arrogance on my part versus trying to help, but it’s been asked before and it’s time once again to try and answer it. Start off with who the lawyer has been in the past. Do you know the lawyers reputation for the work they do? Do you have a friend or co-worker you can speak to about their experiences? How about a friendly lawyer that is willing to talk and can vouch for the lawyer’s reputation. Like real estate law is local; meaning laws are govern by state, county and city and since lawyers are licensed for matter such as these by state bar associations you need to know the local reputation of the lawyer.Category: Workers' Compensation

This first story is about a MoJo. A MoJo is a mobile journalist who covers the Cedar Rapids area of Iowa. The Internet has redefined most everything so why not journalism too? A MoJo can take photos, write stories and then sell content via a web links etc. This journalist is Jeff Raasch from SourceMedia Group News. That’s a great idea Jeff – I like that a MoJo. I’d suggest Jeff carry workers’ compensation insurance and higher limits of auto coverages including uninsured and underinsured motorist coverage. Question: Why do I need a doctor’s opinion, I know how I was hurt.
Answer: In Iowa every workers’ compensation case requires a medical opinion for causation, medical treatment, permanent impairment and restrictions. You know how you got hurt but you’re not qualified to express a medical opinion linking it up to the work environment or accident-mechanism of injury. Of course a single event causing injury, like falling down and breaking your leg is much easier to establish as a work injury than a repetitive injury type of case. In some cases the causing event is so obvious it goes unstated, but that doesn’t mean it’s not required. It’s injuries like carpal tunnel, cubital tunnel, lung injuries, brain damage, head injuries, spinal injuries involving ruptured discs all require a clearly and carefully worded medical opinion as to causation.Category: Workers' Compensation
Welding - On-The-Job Welding Injuries
Once again I’m asked a question I find an interesting one about worker’s compensation. In this instance it has to do with a worker from California that welded for a living, now is older and having medical problems. It’s a difficult question to ask because at this point in the man’s life I’m not sure any legal solution will be enough. Perhaps that is why this question needs to be considered; so that younger workers realize the dangers of breathing the fumes from your work as a welder. Mill Workers Fall From Crane in Pella
Two men working from a crane on the feed mill last Friday fell from heights. The details are sketchy and only one news item was found. See Two men injured after fall at feed mill in Pella. In other news a South Dakota worker died on a job site in northwest Iowa. The Sioux County Sheriff’s office was noted to have reported the death of Andrew Lambert, 46 of McCook Lake, South Dakota after he became trapped in the auger of some drilling equipment. He died at the job site and worked for Certified Testing Services, Inc. of Sioux City. There is a Siouxland Certified Testing Services, Inc., a testing lab at 419 W 6th Street, Sioux City, Iowa 51103-4332 and phone 712-252-5132.Category: Workers' Compensation
