I was reading something Beth Janicek wrote, ‘About More Than Money from San Antonio Personal Injury Lawyer by Beth Janicek a lawyer in San Antonio, Texas. Apparently Attorney Janicek's client's child died from an overdose of morphine from a dental surgery. It's always good to see what Beth is writing about. As for any commenter thinking this is all about money they should consider the bigger picture. The law of torts is about setting standards of how a busy and intricate society will function. The law doesn't just suggest what we should do, it requires the assignment of responsibility by extracting a price for negligent conduct that is wrong; wrongful conduct that causes injury to another is not to be encouraged, but discouraged. It is this civil system of governance that sets America apart from a communist system of government and justice.
Consider for a moment the shooting at Kent State University that took place on May 4, 1970. This event started as a protest by students and turned deadly when the National Guard opened fire on the crowd. Recent enhancement of the audio tape shows an order was given to open fire on the crowd of people. Some people may think it doesn't deserve to be a lawsuit about money, but I disagree. Without the ability to seek compensation we are no different than a communist country like China. Take a look at this AP video news clip and compare it to the Chinese government's handling of the 1989 Tiananmen Square Protests in China.
There are those who will argue that behavior that is simply negligent isn't of the quality and should not be compared with behavior that is intentional. But I disagree. In the law we see behavior that starts out as an act of simple negligence that escalates to intentional acts for profit. Consider for instance the contamination of infant milk formula in China or Fen-Phen or Enron in America. What people need to keep in mind is that what goes around comes around; meaning if something happens to you don't complain that you have no recourse when you've advocated for the demolition of someone's right to seek a financial remedy in America's civil justice system.
Watch these videos and you may gain insight into what is wrong and what is right when we have a strong civil system of financial reparations. And don't forget when Wall Street doesn't fear you there will be nothing stopping the Wall Street crowd from stealing your retirement funds. For me I'd like to know my right to sue for money is firmly intact.
