Know your rights, act proactively and protect yourself.
In the first case Rachel Dollar describes a scheme where the buyers, having a good credit score did not have the means by which to purchase condominiums.

Mortgage fraud takes many forms. In another blog I will review the general types of mortgage fraud. But, in this blog I’ll provide links to several examples of recent cases that were successfully prosecuted.
The mortgage fraud blog has several more stories about mortgage fraud issues and reported stories.

Spoofing is, generally, the act of one person pretending to be someone else, usually in an effort to scam someone or otherwise commit either fraudulent or fairly malicious acts. The word “spoof” is often used in entertainment to mean a type of media that uses imitation to parody another program or work of entertainment. In the sense that it is used in security and fraud, however, spoofing is used because a person is using imitation to appear to be another person or service and gain sensitive information or otherwise maintain an advantage over the unwitting victim.
With commodity prices high copper pipe and wire are to some folks worth stealing. Apparently the price this shiny booty fetches outweighs the risk of jail or prison. But what about the risk of electrocution, does it outweigh the price of copper? An AP report indicates a man in southern Illinois was electrocuted while “stealing copper hit a live wire and was electrocuted.” Wire cutters and copper wire were found near his body. Urban mining is a new term used to describe stealing copper pipes from under inner city or suburban homes and other sources of copper wiring. An electrocution is accidental death by electric shock. According to my lawyer friend from Chicago, if you don’t die it’s just being shocked. The person has to die for it to be an electrocution.
Most golf course owners who were a part of the Royal Links, USA hospitality cart advertising program lost a lot of money. Advertising that was supposed to pay for lease payments never materialized and the program eventually collapsed leaving the owners with making monthly lease payments amounting to over $20,000. It would not have been so bad if the owners hadn't pay $12,500 for what amounts to a Dixie Cup with wheels and a canopy. It wouldn't cool if you didn't add ice and couldn't keep anything warm unless it was made warm. You could pull it behind a golf cart but it wouldn't move on its own. For $12,500 you could have purchased a fancy riding mower and pulled a $200 cart behind it with coolers filled with ice. Many of the leases required venue in Polk County, Iowa, which is why I became involved with representing golf course owners who were sued by the leasing companies.
In other financial news the Iowa Alcoholic Beverage Division is being accused of misspending tens of thousands of taxpayer dollars on artwork, leather chairs, bicycles, a camper, high-definition televisions and other items during a four year period. Hmmmm…. I wish Barbara and I could buy those through the Lombardi Law Firm or our commercial real estate business. The IABD is also under review for questionable practices having to do with bidding out work for office renovations.
I’ll offer to be an intermediary between you and Mr. Charles Duttweiler. You return the things he needs to my office or call my office and letting me know where you placed them. Fair enough?
Today’s post under the getting ripped off section is a positive news story. It’s one that exemplifies the true American spirit. It’s about a can-do America that runs on honesty, hard work and roll-up-your-sleeves community values. It’s not about what government can do for me or who gives me the next benefit check or me-me-me being the center of attention. Some of you, who can’t mow grass, cut weeds or afford to fix city parks may wonder how you too can help. Here is my low-budget list of ways to assist these volunteer citizens that won’t cost you a whole lot. I wondered if I could come up with 50 suggestions and I did.
Medicaid is a medical program for those who are poor, have no insurance and meet the program qualifications. A woman in Waterloo, Iowa has pleaded guilty to filing $43,000.00 in false claims from 2004 to 2009. Apparently she used someone else’s name and provider number. Medicare and Medicaid false claims are a crime. This kind of fraud has been found in the past involving medical service provider and patient. If you are a hospital worker and know of such systematic fraud you can be financially rewarded for turning in those involved. Call us if we can assist you. It’s called a qui tam action (also known as the False Claims Act) and has been a part of the federal law since the civil war.
And in other news having a questionable financial angle… it’s been a very busy week for new and old financial rip-off schemes by blue, black, grey, pink and white collared criminals. Our old friend Scott Rothstein, who pleads guilty to operating a $1.3 billion Ponzi scheme from his law office in south Florida, was sentenced to 50 years in a federal prison. Is $1.3 billion enough to create a cloud of suspicion for other criminal activity? Meanwhile his former office manager awaits her fate after being charged in the matter and the investors await further criminal charges and the recoupment of their investments.
Today’s news item comes from the Lemon Drop and is about a young lady who after calling off the wedding returned everything except the $17,000.00 engagement ring. This Runaway Bride hails from New York. Her reasons are reported to be other money owed by the former fiancé along with his giving her the ring on her birthday; she claims it was a gift. But this latter claim I don’t buy because birthday or not the ring had nothing to do with the birthday; it had to do with marriage.
Iowan's insured by BCBS may be eligible for some money. BCBS's computers don't seem to know left from right and have been denying claims due to a mix up.
