Two vehicles in Iowa's Worth County on Highway 65 hit head-on because one lost control. It's the reason for the loss of control that should be on the mind of the female driver who was seriously injured and flown to Mercy Hospital in Mason City. Apparently she was a passenger in the car being driven by 33-year-old Benito Zapata-Gutierrez of Austin, Minn. And this raises an interesting question which Mike Bryant discusses in his St. Cloud post. If you want to see how complicated things can get see how interesting this one will get when it comes time to settle or try it. You have drivers from different states, the one not at-fault from Minnesota and the other from Northwood. The place where they collide is Iowa, on Highway 65 in Worth County. The Worth County Sheriff's Office handles the investigation for the parties involved. Hopefully there is insurance and my guess is the insurance companies are from different states, probably not either Iowa or Minnesota. Because the accident is covered by the sheriff's office there is no Iowa State Patrol report; so good luck with the insurance adjusters confusing the issues. The only other accident in Worth County, Iowa is an I-35 crash on December 11, 2010. This accident was covered by the Globe Gazette in north Iowa. Do you need an Iowa lawyer, a Minnesota lawyer or both?
So what made the one driver drift across the center line and have to fight to get control of his car? Why was he placed in that position? If anyone says "it was the weather" I'm going to scream, because Old Man Winter doesn't drive and therefore he can't cause a loss of control of a car or truck or anything that drives. So what was the distraction?
