Tort Reform Cake with Health Care Reform Fondant Frosting

America can’t start to solve its economic problems until it begins to show resolve to take on those who are ruining our way of life and the future of our children. So today I’ve come up with two proposals that will eliminate life-time members of Congress; unless they truly believe in service to the public and can think of ways of creating jobs for Americans in America.

This discussion circling around health care reform and tort reform is getting us no where; which is exactly what those in power want. They pit Americans against each other through polarized arguments that distract the voters into forgetting that nothing is getting done. Most debate right now is being run by emotional button pushers, not genuine problem solvers who think about solutions (instead of how to win the next election). First we need to get rid of the distracters and second we need to make those creating the polarization put their money where their mouths seem to run.

I'd expect the leadership of the U.S. Chamber of Commerce, the U.S.-China Chamber of Commerce and their evil sister, the American Tort Reform Association to be the first to sign off and send in their forms. I'll act as the clearinghouse for all filings.

HEALTH CARE REFORM - Give Them What They Are Giving Us

As of June 1, 2010 the Congress shall be insured for health benefits through America's county health care system.  The U.S. shall reimburse the county health care system for the cost of said care.

TORT REFORM - Medical Stand Up For What You Advocate Form

Whereas, anyone wishing to opt out of having the right for seek compensation for injury caused by medical processes or procedures shall have the right to do so by executing an official federal civil justice opt-out form.

Whereas, the Congress is aware that many people seek to limit or prohibit others from obtaining compensation for medical injury or death. Those who wish to limit other's rights to compensation should be required to opt into a medical compensation free-zone by signature on a compensation waiver form.

Whereas, this is for the leaders of the U.S. Chamber of Communism and it's evil sister, The American Tort Reform Association and all it's pork barrel suggestions of what the leadership holds-out as reforms that does nothing but line the pockets of its secret membership, which in the opinion of many is more likely than not the Communist Party in China.

TORT REFORM COMPENSATION WAIVER FORM

Putting my money where my mouth goes!

I, ___________________________, hereby declare my intention to opt-out of the U.S. civil justice system by waiving my right to ever seek compensation in the various courts of the United States for medical errors. I will self insure myself and my family for wage loss, medical costs, prescription charges, reduced earning capacity that causes future wage losses, future medical care and quality of life damages.

I, ___________________________, am willing to set aside $____________ per year to cover the costs of protecting myself and family from the catastrophic effects of a medical error.

I realize by signing this form I WILL NOT seek compensation, though I may be injured or killed through medical errors. Those medical errors may include but are not limited to the following events: anesthesia, surgical, prescription medications, infections, wrong-site, wrong-patient, wrong-procedure or other preventable causes.

I declare my understanding that some medical errors can cause life threatening injuries that render me or a family member brain dead, although technically still alive. I will insure against the possibility that my family may never have the same lifestyle, including that my children may never be able to afford a college education.
