Steve Lombardi, Attorney

In this collision we see two trucks coming from opposite directions on Iowa Highway 44 in Shelby County. From the report, the one cuts the corner placing its wheels over the center line. The oncoming driver sees the truck in his lane of travel and tries to avoid the truck while maintaining control, but ends up with a near head-on collision killing both drivers.

One driver is from Minnesota driving a semi, the other from Portsmouth, Iowa driving a GMC Jimmy and of course normally he’ll fair the worst. There is also a 68 year-old female passenger that seemed to be alright although I’m sure the next day she woke up feeling the impact.

This is another accident with all drivers and passengers having claims although some are competing with each other and their own insurance company.

NARRATIVE

On 6-24-12 at approximately 1635 hours Vehicle #1 was driving east on Hwy 44 approximately 1 mile east of Portsmouth. Vehicle #2 was traveling west at the same location. Vehicle #2 failed to stay in its lane as it entered a right hand curve. Vehicle #2 crossed the center line into the east bound lane. Vehicle #1 attempted to take evasive action. Vehicle #1 braked and steered to the right. Vehicle #1's passenger side left the roadway on the right shoulder. Vehicle #2 struck Vehicle #1 in an off-set head on collision. Vehicle #2 was spun around and came to a stop on the north shoulder facing east. Vehicle #1 front driver's side steer tire was crushed back under the vehicle. This caused vehicle #1 to cross both lanes of traffic and enter the north ditch. Vehicle #1 stayed on its front wheels, but its trailer rolled onto the drivers side. Vehicle #1 caught fire and burned. Both drivers died as a result of their injuries. Vehicle #2 boat trailer IA 3122NE. The boat VIN is LUNE5097M82B.
