As an Iowa personal injury lawyer I’ve seen my share of rollover accidents but this one appears to be more serious than many. In the car were six people. (Passengers and the driver include Patrick Taylor (Osage Iowa, 22), Jesse Wilson (Charles City, Iowa, 22), Clinton Deaton (Osage, Iowa, 25), Carissa Dolan (Texas, 16), Aimee Deetz (Charles City, Iowa, 24) and Caitlin Block (Orchard Iowa, 20)). The passengers have the best chance of recovery, but only if they get in quickly to secure insurance coverage and then they will probably need to have their own underinsured motorist coverage. The driver has his hands full with explaining why or how he lost control. The Insurance adjusters will move in for the recorded statement and that's where the real trouble will begin. Know what you are doing and think about what you are saying before you talk to an adjuster. If you have a claim always sit down first with a lawyer to discuss the nature of your claims because remember there are just two reason why and adjuster sits down to talk with you; and neither reason is good for you.
This is a mess of an accident and the summary by Troopers Snieder and Lopez doesn’t fully explain the cause.
SUMMARY: VEHICLE 1 WAS SOUTHBOUND ON HICKORY AVE APPROXIMATELY 1 MILE NORTH OF HWY 9 WHEN THE VEHICLE LOST CONTROL AND LEFT THE ROADWAY, THE VEHICLE ROLLED SEVERAL TIMES COMING TO REST UPRIGHT IN THE NORTHBOUND DITCH - THE ACCIDENT REMAINS UNDER INVESTIGATION.
There are two avenues to pursue in forensics:
- The blood alcohol content;
- And, the cell phone records.
The Iowa State Patrol accident reports don’t stay up forever but we’ve saved a copy in the event we find our firm representing one or more of the passengers. Call us if we can help. 515-222-1110 or [email protected]
