Passing a semi and maintaining control

In other personal injury law news a single car accident in Adair County was caused when the driver of a Mercury Sable lost control after attempting to pass a semi-truck. The report has the driver’s side tire (wheel) dropping off the pavement and then the driver losing control. A passenger died from injuries suffered in the crash. (James Rinkert) Another passenger, Susan Rinkert was also injured and taken to Mercy by Air Ambulance. The insurance should pay on this claim. The bigger question is rounding up other insurance coverage to pay the estate claim and the other passenger’s medical, reduced earning capacity, permanent impairment and wage loss claims. (Not to mention pain and suffering.) Our office is currently working on at least 10 large damage cases similar in size and scope. We tend to do a lot with death claims for estates.

NARRATIVE

UNIT ONE WAS NORTHBOUND ON P33 PASSING ANOTHER VEHICLE WHEN THE DRIVER DROPPED OFF THE EDGE OF THE ROADWAY TO THE LEFT AND WAS UNABLE TO REGAIN CONTROL. THE VEHICLE THEN IMPACTED A RIVER EMBANKMENT WHERE IT CAME TO A FINAL REST. THE REAR SEAT PASSENGER WAS PRONOUNCED DEAD AT THE SCENE BY ADAIR COUNTY MEDICAL EXAMINER. THE OTHER OCCUPANTS WERE TRANSPORTED BY AMBULANCE TO GREATER REGIONAL MEDICAL CENTER IN CRESTON AND THEN AIR LIFTED TO MERCY MEDICAL CENTER IN DES MOINES. THE VEHICLE WAS REMOVED FROM THE SCENE. THIS ACCIDENT REMAINS UNDER INVESTIGATION.
