Question: Who has the right of way at an uncontrolled intersection?

Answer: The car on the right has the right-of-way. The car that controls the intersection is the one already into the intersection. If they arrive at the same time then the one to the right gets to have the right-of-way. Control means the car is already into the intersection. First in - first out.

Is it legal to drive distracted - Yes if you obey the laws.

Wright County, Iowa - Here is another report of an uncontrolled intersection accident in rural Iowa that results in a fatality. We've got one vehicle heading east on 240th Street and a second heading north on Keokuk Street and entering this uncontrolled intersection at about the same time. The northbound vehicle strikes the eastbound vehicle in the passenger door; which would seem to imply the car struck was first to enter the intersection. The farther down the side the initial contact the more the facts indicate the car being struck had control of the intersection. The next question is one of speed. Of course until we know more about speeds and acceleration issues we will not be able to draw conclusions about fault. Speeds can be determined with an expert who can measure penetration depth and from the extent of impact ascertain or determine speeds.

But according to our earlier post about the accidents in the Dows' area, Delaware and Adams County we know the car to the right has the right-of-way. But remember that requires simultaneous entry, which in this case is what the Trooper reports.   A passenger in the Grand Prix died in the crash and he was only 15 years-of-age. This of course is the kid from Dows as we originally reported. So for the sake of safety let's repeat the rule here again.

Driving Distractions Can Be Deadly, May 12, 2010

Looking back let's ask the same questions from the previous posts.

The question and answer were about which car will have the right-of-way.

Question: In Iowa what driver must yield at an uncontrolled intersection?

Answer: If you're coming from the left you shall yield the right-of-way to the vehicle on the right.

When the negligent or at-fault driver dies will their insurance still pay for the other driver’s injuries?

Can a child be sued when he shoots another hunter?

Do I have to cover someone's medical bills if I accidentally caused an injury? The guys hand was broke now we have to pay for the surgery and everything else. I offered that day to take him to get his hand x-rayed. He declined and then two days later took himself to the ER and found out it was broken then had to have surgery to put pins in it. I offered to help pay and have paid him $300 so far. Now his next bill he wants me to pay is $1030 and that doesn't included surgery bills yet. He said he will sue me if I don't pay all of his bills. When is enough enough?
