Iowa State Patrol Fatality Reports for Saturday, July 2, 2011.

Today is July 3, 2011 and I'm going to list the personal injury accidents and crashes on the Iowa roads and interstate highway system. They come off the ISP website but you are free to contact me if you want further assistance. I can be reached by email at sdlombardi@aol.com or by phone 515-222-1110.

Every Saturday this law firm posts the current Iowa State Patrol fatality and injury report list so our out-of-state clients and potential clients have access to the latest word from the Iowa State Patrol. If you have questions about what the investigating officer's report means, or how to interpret it, give Steve Lombardi a call at 515-222-1110 or send him an email at sdlombardi@aol.com. Here are the injury reports for July 2, 2011. The crash reports from last week are at this link. The crash reports from previous weeks are at the links way down at the bottom. If you follow this link to the Lombardi Law Firm category Interstate 35, I-80, I-235, I-380 Collisions/Accidents you can find most Iowa State Patrol crash reports linked and some, but not all, are analyzed. Look along the left column under The Verdict to see if the date of your accident is shown; if it is simply click on the linked title that should include a date. There are two for every Saturday. One is for fatality reports and the other for injury crash reports. If you or an interested person are in a collision and you would like the crash analyzed you'll need to contact Attorney Lombardi. This may or may not result in an attorney-client relationship and simply asking for a review does not in and of itself create such a relationship. If you ask and Mr. Lombardi thinks you have a case he will say so and provide an agreement for representation that then creates an attorney-client relationship. The bottom line is that Mr. Lombardi has to agree to take you on as a client; the first step of course is asking him. You've got two ways: telephone 515-222-1110 or email sent to sdlombardi@aol.com. Crash: Crash:
Minimal Reports A crash occurred in Mahaska County on July 1, 2011
Facts: The Buick is alleged to have run into the rear of the tractor, a 1948 John Deere Model B. The one is from Oskaloosa and the other from Ankeny. The guy on the tractor died; he was 71-years-old. Issues will center on lookout which leads to questions about distractions and why the Buick driver didn't see the tractor. VEHICLE #1 AND VEHICLE #2 WERE BOTH EASTBOUND ON HIGHWAY 163,THE FRONT OF VEHICLE #1 COLLIDED WITH THE BACK OF VEHICLE #2,BOTH VEHICLES ENDED UP IN THE SOUTH DITCH--CHARGES ARE PENDING,THE ACCIDENT IS STILL UNDER INVESTIGATION Another story from KCRG.   A crash occurred in Monona County on June 30, 2011
Facts: This is a single vehicle accident where the driver is reported to have died after being ejected when the 2001 Ford F350 pickup truck lost control and ended up on its side. Issue here is whether the use of a seatbelt would have save his life and what caused the driver to lose control. VEHICLE WAS NORTHBOUND I29 AT 116 MM NB LOST CONTROL WENT ACROSS THE MEDIAN CAME TO REST ON ITS SIDE IN THE WEST DITCH OF SOUTHBOUND I29 SUBJECT WAS EJECTED TRANSPORTED TO BURGESS HOSPITAL ...   A crash occurred in Jasper County on June 25, 2011
Facts: The way the report is written up the driver who failed to stop at the stop sign and to yield the right-of-way got t-boned by the row vehicle; the offending driver was killed. I'm sure it didn't do Ingrid Sawyer, 36, any good either. She is from Newton, Iowa. The right-of-way driver was heading south on Highway 14, the other driver was driving from her left or heading west; meaning the collision was to the passenger side by the front of the other car. VEH 1 WAS SB ON HWY 14, VEH 2 WAS WB ON S 24TH AVE WEST, VEH 2 RAN THE STOP SIGN AT S 24TH AVE W AND HWY 14, CAUSING VEH 1 TO STRIKE VEH 2'S PASSENGER SIDE DOOR, VEH 2 CAME TO REST IN THE SW CORNER'S DITCH, VEH 1 CAME TO REST IN THE SB LANES OF HWY 14, INVESTIGATION PENDING, NOT SPEEDWAY TRAFFIC RELATED.   A crash occurred in Benton County on June 18, 2011
Facts: Single car accident with a fatality and not enough of a description to know if a seatbelt would have saved the driver's life. The report indicates no seatbelt was being worn. BARKER WAS EASTBOUND ON 61ST STREET LANE AND FAILED TO NEGOTIATE A CURVE, SLID INTO THE SOUTH DITCH AND ROLLED, HE WAS PRONOUNCED DECEASED AT THE SCENE ... Facts: This Benton County accident on I-80 westbound sounds very similar
Full Reports A crash occurred in Scott County on June 30, 2011
UNIT 1 WAS TRAVELING EASTBOUND. UNIT 1 CROSSED THE MEDIAN OVERTURNED AND CAME TO REST IN THE WESTBOUND LANES, FACING WESTBOUND. Facts: This Scott County one-vehicle accident seems very similar to the one on Monona County above. The driver is a 43-year-old woman from Denver, Colorado. It's indicated she was fatally injured. The one passenger mentioned is Thomas Muenzberg who was hospitalized at Genesis East by Durant Ambulance. Like every passenger that is injured the issues surround the driver's driving and center around why there was a loss of control, lookout and of course speed. After loss issues have to do with reacting to the loss of control. This is an I-80 crash on June 30, 2011 at 4:50 PM at mile marker 284 eastbound.   A crash occurred in Chickasaw County on June 23, 2011
This crash from Chickasaw County is another single car crash on southbound US 218 at mile marker 220.25. It looks like an elderly couple, the Quinns, from Woodbury, Minnesota driving in a 1999 Buick Park. We do right back to the previous accident and center the legal issues around the driver's driving and center around why there was a loss of control, lookout and of course speed. After loss issues have to do with reacting to the loss of control. UNIT #1 WAS SOUTHBOUND ON HIGHWAY 27/218 IN THE INSIDE LANES. UNIT #1 DROVE ONTO INSIDE SHOULDER, DROVE BACK ONTO ROADWAY, AND DROVE ONTO INSIDE SHOULDER AGAIN. THE DRIVER THEN OVER CORRECTED TO THE RIGHT CAUSING UNIT #1 TO START ROLLING. UNIT #1 CAME TO REST UPRIGHT IN THE SOUTHBOUND LANES.   A crash occurred in Dallas County on June 22, 2011
Facts: This crash is in the county adjacent to my territory, Polk County. We actually own land in Dallas County. The driver is 44-years-old from Perry and driving a 2003 GMC Sierra. A blood alcohol test was performed and pending the results this investigation could be concluded. I guess the description below says it all when the officer writes about being impaired by alcohol, not wearing a seatbelt and having enough speed to cause the vehicle to rollover. The accident occurred at 2:16 in the afternoon on what appears to be a city street or a county road. **** EXPLAIN THE VEHICLE ACTION FOR UNIT 001 VEH #1 WAS NORTHBOUND IN THE 14000 BLK OF H AVENUE WHEN IT ENTERED INTO A CURVE IN THE ROADWAY. THE DRIVER OF VEH #1 FAILED TO MAINTAIN CONTROL AND WAS UNABLE TO NEGOTIATE THE CURVE. VEH #1 THEN ENTERED PARTIALLY INTO THE EAST DITCH, SLID SIDEWAYS, AND THEN PARTIALLY ENTERED BACK ONTO THE ROADWAY WHERE IT ROLLED ONTO its TOP CAUSING MAJOR DAMAGE TO IT'S ROOF AND PASSENGER COMPARTMENT. THE DRIVER OF VEH #1 WAS IMPAIRED BY ALCOHOL, NOT WEARING A SEATBELT, AND RECEIVED FATAL INJURIES DURING THE ROLL-OVER..   A crash occurred in Jasper County on June 21, 2011
Facts: Next we'll head east to Jasper County for this June 21st accident. This is a two-vehicle accident involving a stop sign, a failure to yield the right of way and US Highway 6 at E125th Street North. The driver, Kalleen Buchmeier from Grinnell died. She got struck on the driver's side at what appears from the diagram to be a direct impact on a road where the speed limit is 55 mph. The other driver, Stan Hopwood, 44 from Newton was probably injured as well. No injured passengers are mentioned. Legal issues of negligence will involve a failure to yield, lookout and driving with due care. Of course estate administration is also a reason to hire a lawyer. UNIT # 1 WAS GOING SOUTH ON COUNTY ROAD. UNIT #2 WAS GOING WEST ON HIGHWAY 6. UNIT # 1 STOPPED AT THE STOP SIGN, THEN PULLED INTO INTERSECTION INTO THE PATH OF UNIT # 2. UINT # 2 STRUCK UNIT # 1 BROADSIDE IN THE DRIVERS DOOR. BOTH VEHICLES REMAINED ON THE ROADWAY AFTER IMPACT.   A crash occurred in Cedar County on June 20, 2011
Facts: Yes I'm getting tired and yes I have lawn work to do but no I'm not going to quit just yet. One vehicle, a pickup truck, one passenger, Daniel Mohr and the driver, Scott Dierks was fatally injured.   UNIT 1 WAS GOING NORTH BOUND ON QUINCY AVENUE AT 120TH STREET. AT THE SPOT OF THE ACCIDENT QUINCY AVENUE IS A GRAVEL ROAD. AS UNIT 1 WAS GOING THROUGH A CURVE IN THE ROAD UNIT 1 DROVE THROUGH A SMALL RAIN WASH OUT. THE DRIVER LOST CONTROL OF UNIT 1 AND IT OVERTURNED ON TO THE PASSENGER SIDE. AS UNIT 1 OVER TURNED THE DRIVER WAS EJECTED. THE DRIVER WAS TRANSPORTED FROM THE SCENE FOR INJURIES SUSTAINED IN THE CRASH. THE PASSENGER DIDN'T SEEK MEDICAL TREATMENT. Report Notes: Driver Condition: 6 - Under the influence of alcohol/drugs/medications   A crash occurred in Benton County on June 18, 2011
Facts: Another one-vehicle accident, this one in Benton County on June 18th. This one looks a lot like the Mohr-Dierks accident. Same type of accident and same type of issues. Location: E024 / 61 ST LN measuring 0.7 Miles East from W026 / 32 AVE and E024 / 61 ST LN UNIT 1 WAS TRAVELING EB ON 61ST STREET LANE. UNIT 1'S DRIVER OVER STEERED UNIT 1 TO THE RIGHT WHILE NEGOTIATING A CURVE. UNIT 1 BEGAN TO ROTATE CLOCKWISE AND STARTED TO SLIDE IN TO THE SOUTH DITCH. UNIT 1 ROTATED COUNTERCLOCKWISE AS IT CONTINUED IN TO THE SOUTH DITCH AND BEGAN TO ROLL SIDEWAYS IN A EAST DIRECTION. UNIT 1 CAME TO FINAL REST ON ITS RIGHT SIDE FACING NORTH IN THE SOUTH DITCH. Report Notes: Driver Condition 6 - Under the influence of alcohol/drugs/medications Here is a recap of today's car accidents resulting in the death of either the driver or a passenger. Crash:
