Today there is a single fatality report on a collision between two cars; you have one minivan coming across the center line after losing control and sliding right into the path of an oncoming Mazda 626 Sedan on Highway 30 at the 96.5 mile marker at 3:55 pm on February 6, 2011. The driver of the minivan was a 76-year-old man and of the second a 31-year-old woman from Jefferson, Iowa. The driver of the Chevy Venture minivan died and the report indicates blood tests were performed for alcohol, although you can't draw any conclusions until the test results come out, which will probably be several weeks from now. The report notes this man did not use a seat belt of shoulder harness, although his airbag did deploy.

The female driver of the Mazda, Magenta Garner, was not administered any tests and she was injured and taken away by the Greene County Ambulance service to Greene County Medical Center.

The speed limit on this road is noted to be 55 mph. The weather conditions reported to be blowing sand, soil, dirt and snow; so it must have been that very windy day. Both weather conditions and road conditions were noted on the report although only as a condition without much detail. Photographs of the scene should be taken along with the damaged vehicles to really get a good handle on exactly what did happen. An investigation would center on speed, lookout and existing road conditions along Highway 30 up to the place where control was initially lost.  If road conditions were bad all along Highway 30 then the driver would be on notice of severe conditions and should slow down accordingly; especially when we are talking about a 2-lane road and not a divided highway.

But there is another aspect to this case that is interesting. There were at least 4 passengers in these two cars; injured in the Mazda was one passenger and in the minivan 3 passengers. Drivers owe a duty to passengers along with other drivers and passengers in the oncoming car. This means the driver of the minivan if found at fault (negligent) his insurance could be paying for the injuries and damages of not just the other driver but all the passengers as well. In this instance the driver did die, that's unfortunate and we don't mean to slight this poor man, but the law has to march on and take care of assigning liability and compensating the living, so those four people will be concerned with how the little bit of insurance money is to be divided amongst them.

Which brings us to another issue: did any of the passengers have other auto insurance that can be used to pay bills and damages? I note the passenger in the Garner vehicle is 35 (David Wilcox) and he may certainly have a driver's license and other auto insurance to assist with his recovery. In the minivan (Raymond Sorenson) the passenger (Nikki McAllister) is 26 and she may have other insurance which like all passengers should place their own insurance agent on notice of a potential claim. In that car were to very young children, one 3 and another tyke that is 2. Each was in the rear seat and appears to have been in a child safety seat, so they are probably in better shape than the adults in that car. I see the report points out both infants were taken to the Greene County Medical Center, probably to check them out and make sure they are alright. If it's the mother in the front passenger seat you know she's upset.

All in all this is a very complicated insurance matter that is further complicated by the death of one of the drivers, who from the report appears to be the likely at-fault driver, at least from what the report indicates. I'm going to guess that two years from now these people will still be dealing with the aftermath of this two-car crash in Greene County, Iowa.
