Legal issues: Did the driver suffer from a medical condition that was unexpected.

A crash occurred in Johnson County on April 8, 2011
VEHICLE 1 SEMI TRACTOR TRAILER COMBINATION WAS TRAVELING NORTH BOUND ON I380 IN THE RIGHT LANE AT THE 5 MILE MARKER, VEHICLE A WAS PARKED ON RIGHT SHOULDER AND DRIVER EXITED VEHICLE AND WALKED INTO PATH OF ONCOMING VEHICLE 1, DRIVER OF VEHICLE 1 ATTEMPTED TO AVOID PEDESTRIAN,ON GOING INVESTIGATION BY IOWA STATE PATROL AND JOHNSON COUNTY SHERIFFS OFFICE.

VEHICLE 1 WAS TRAVELING EASTBOUND ON HIGHWAY 64 PASSING ANOTHER VEHICLE TRAVELING EASTBOUND. VEHICLE 1 MOVED BACK INTO THE EASTBOUND LANE AND LOST CONTROL, TRAVELED OFF THE ROADWAY TO THE SOUTH AND ROLLED SEVERAL TIMES. THE DRIVER AND PASSENGER WERE EJECTED.

Legal issues: Was the driver at fault and therefore liable for the passenger's damages?

VEHICLE # 1 WAS TRAVELING SOUTHBOUND ON STUART STREET IN SIGOURNEY AND VEHICLE # 2 WAS LEGALLY PARKED ON THE WEST SIDE OF STUART STREET. VEHICLE # 1 DROVE INTO THE BACK OF VEHICLE #2.

VEHICLE #1 WAS EASTBOUND ON G77 (WAPELLO-MAHASKA RD.) VEHICLE #1 STOPPED IN THE EASTBOUND LANE TO BACK HIS UNIT INTO A FARM DRIVE ON THE NORTH SIDE OF THE ROADWAY. NO OTHER VEHICLES WERE VISIBLE TO THE EAST OR WEST. VEHICLE #1 BEGAN BACKING THE TRAILER ACROSS THE ROADWAY. VEHICLE #2 WAS TRAVELING WESTBOUND ON G77. VEHICLE #1'S TRACTOR WAS IN THE EASTBOUND LANE HOWEVER HIS TRAILER WAS ACROSS THE WESTBOUND LANE. VEHICLE #2 DID NOT SEE THE TRAILER ACROSS HIS LANE OF TRAVEL AND STRUCK THE LEFT REAR TANDEMS OF VEHICLE #1'S TRAILER. VEHICLE #1 PUNCTURED THE TRAILER OF VEHICLE #2 CAUSING CONTENTS (LIVESTOCK FEED) TO SPILL OUT ONTO VEHICLE #2. VEHICLE #2 ALSO CAUGHT FIRE IN THE ENGINE COMPARTMENT FROM THE IMPACT AND THE FIRE SPREAD THROUGHOUT THE VEHICLE. IT WAS NOTED THAT VEHICLE #1 HAD ACTIVATED HIS FLASHERS PRIOR TO THE COLLISION HOWEVER HIS HIGH BEAM HEADLIGHTS WERE ALSO ON MAKING IT DIFFICULT FOR DRIVER OF VEHICLE #2 TO SEE THE OBSTRUCTION IN HIS LANE. THE DRIVER OF VEHICLE #2 WAS PRONOUNCED DEAD AT THE SCENE.

Legal issues: Due care and lookout involving the blocking of a public highway or road. If there was a rise in the roadway that would prohibit Shawn Shaffer from seeing and having enough time to avoid the Nutri-Tech Feed truck then that may be something the semi-truck driver should have anticipated requiring him to use a spotter or to put out warning symbols before blocking the road with this backing semi-truck.

Look along the left column under The Verdict to see if the date of your accident is shown; if it is simply click on the linked title that should include a date. There are two for every Saturday. One is for fatality reports and the other for injury crash reports. If you or an interested person are in a collision and you would like the crash analyzed you'll need to contact Attorney Lombardi. This may or may not result in an attorney-client relationship and simply asking for a review does not in and of itself create such a relationship.
