Iowa Highway's 30, I-80 and 965 Personal Injury Accidents

Today let's look at the six personal injury reports from November 5th to November 15, 2010. There is one each from the following counties: Cedar, Mills, Scott, Johnson, Dubuque and Cass. The highways include Highways 30, I-80, Highway 965 and a second on I-80.

Cedar: This is a tough 85-year-old man from Lost Nation. I always liked the name of this town - Lost Nation! It sounds tough to me. But look at this driver refusing medical attention after rolling his car.

UNIT ONE WAS WB ON HWY 30 TIRE DROPPED OFF ONTO RIGHT SHOULDER AND LOST CONTROL VEH ROLLED COMING TO REST IN SOUTH DITCH ON RIGHT SIDE DRIVER WAS TRAPPED IN VEH AND THEN FREED BY A PASSERBY VEH THEN CAUGHT FIRE DRIVER OF UNIT ONE REFUSED MEDICAL TREATMENT

Mills: This could be the same accident as in Cedar County. This is a single vehicle rollover with the driver and the passenger refusing medical treatment. What's bothersome about this one is the possibility of a child endangerment charge. The passenger is 8-years-old and the driver, same last name, is 46. I would caution parents that refusing medical treatment for yourself is entirely different than for a child and if something is later determined medically wrong with the child you can be charged for child endangerment. So be careful with refusing medical attention for your child.

UNIT 1 WAS NB ON 221ST, LOST CONTROL ON ICE, OVERTURNED, AND CAME TO REST IN THE E DITCH DRIVER REFUSED TREATMENT, BUT DID HAVE MINOR VISIBLE BLEEDING PASSENGER WAS TREATED AND RELEASED BROWNS TOWED THE VEHICLE PRIVATELY

Scott: This one is interesting in that it involves drivers from different states, Tracy, California and from Overland Park, Kansas. The Kansas driver is a 75-year-old Barbara Brooks Anselmi. She is driving a 2006 Toyota Camry. The California driver is Floro Gagante, age 45 driving a 2011 International Semi-truck. The truck must be brand new. As you can see the California driver rear ended rear ended the semi-truck. With the accident being under investigation and considering the driver's age there must be some lab work being conducted to determine if additional charges are warranted. What most people don't appreciate is how their lives are saved from a little piece of metal affixed to the rear of the semi-trailer. You'll see it along the back side and it prohibits a rear ending vehicle from sliding underneath the semi. That prohibits the offending vehicle's driver from being decapitated.

VEHICLE TWO -SEMI- WAS EAST BOUND ON INTERSTATE 80 AT APPROXIMATELY THE 303 MILE MARKER WHERE IT SLOWED DOWN DUE TO UPCOMING TRAFFIC CONGESTION, VEHICLE ONE -CAMRY- WAS EAST BOUND ON INTERSTATE 80 AND REAR ENDED VEHICLE TWO, ACCIDENT REMAINS UNDER INVESTIGATION

Johnson: This is a single-vehicle rollover accident caused by a loss of control after the driver suffered a medical condition which appears to have affected his level of consciousness. This 72-year-old driver had several passengers in the car, including 6, 11 and 69 year olds. It looks like everyone went to the hospital.

VEHICLE ONE WAS SOUTH BOUND ON HWY 965 JUST NORTH OF THE IOWA RIVER WHEN THE DRIVER PASSED OUT DUE TO A MEDICAL ISSUE - VEHICLE ONE THEN STRUCK THE EAST GUARDRAIL AND DROVE OFF THE RIGHT SHOULDER, STURCK THE RAILROAD EMBANKMENT, AND ROLLED OVER

Dubuque: Like another case we recently reported on this one is an intersection with a stop sign where the driver pulls out without yielding the right of way to oncoming traffic. The offending truck is a pickup truck versus a 2007 Kia van, which isn't going to favor the Kia driver. Involved were Stacey Welling from Cascade, Iowa and Daniel Hess from Luxemburg, Iowa. The collision occurred at around 3:15 p.m. on November 16, 2010.

VEHICLE 1 WEST BOUND HAD STOPPED AT STOP SIGN, DID NOT SEE VEHICLE 2 SOUTH BOUND AND PULLED OUT, VEHICLE 2 STRUCK VEHICLE 1 WITH THE FRONT OF VEHICLE 2 IN THE RIGHT REAR OF VEHICLE 1

Cass: Alright, our last report and then I'm going to have a Pilgrim Sandwich is out of Cass County is a single-vehicle semi-truck accident driven by Robert W. Chesser from Wyandotte, Kansas.  He was taken to the Cass County Memorial Hospital by Atlantic Medivac after he went off the road, into the ditch and slid to a stop off of I-80. He's lucky to be alive. The truck's carrier is noted to be Wes-Lyn Enterprises again out of Wyandotte, Oklahoma. He'll have a workers' compensation claim out of Iowa even if the investigation proves he was at fault; because in Iowa fault has nothing to do with a workers' compensation claim. Collision time is around 2100 hours which is 9:00 p.m..

VEHICLE WAS EASTBOUND ON I80 WHEN THE VEHICLE WENT RIGHT TO THE SOUTH DITCH DRIVER TRIED TO STEER THE VEHICLE OUT OF THE DITCH VEHICLE THEN ROLLED ON TO ITS RIGHT SIDE SLIDE DOWN THE PAVEMENT AND CAME TO REST FACING NORTHEAST ON ITS RIGHT SIDE

If you or an interested person are in a collision and you would like the crash analyzed you'll need to contact Attorney Lombardi. This may or may not result in an attorney-client relationship and simply asking for a review does not in and of itself create such a relationship. If you ask and Mr. Lombardi thinks you have a case he will say so and provide an agreement for representation that then creates an attorney-client relationship. The bottom line is that Mr. Lombardi has to agree to take you on as a client; the first step of course is asking him. You've got two ways: telephone 515-222-1110 or email sent to sdlombardi@aol.com.
