A few years ago it seemed whenever we filed dog bite cases we’d get contacted by local owners of vicious dogs along with the national and local dog owner’s association, who would tell us we had it all wrong. They would then go on ad nauseam about how a 4-year-old had teased the dog and that the mauling of a toddler was somehow justified. As if the 4-year-old should have known better and that parents who allowed their children to play outside in their own yards, were somehow bad parents. Give me a break.
Frankly I’m not sure without knowing more about the accident sequence and whether the driver should not have pulled out from safety. It’s a difficult call without seeing and examining the physical evidence and knowing something more about the location. It is an interesting case though.

The accident happened in Hickory County, Missouri and was investigated by the Missouri Highway Patrol. Accident occurred on U.S. 65 about three miles north of Preston. They were driving a 2006 Toyota Corolla. I’ve not heard of steering problems in those cars, but a quick check on the Internet indicates otherwise. In February of this year steering problems were reported in 2009 and 2010 Toyota Corollas.
A house fire occurs; one person dies and another escapes. The survivors and relatives show up at your office and want the lawyer to help them get some answers. I’ve seen this issue several times as a lawyer and carbon monoxide poisoning causes death and other serious health problems. Landlords and other building owners get themselves sued when they’ve failed to conduct regular maintenance and normally it’s pretty obvious that a lack of maintenance is present. In Alta Vista a two-year-old was thrown from a horse drawn buggy and was killed. The horse bolted and it appears as the father was unhitching the buggy, the horse was spooked, took off running and the buggy ended up entangled in a tractor with steel wheels. The young girl was thrown and pinned between the buggy and the steel wheels.
The remains found in a farm field in Mahaska County, Iowa are those of a 24-year-old Fremont man missing since October 2008. The man was reported by his dad to have suffered from schizophrenia and took his own life.
Several children were pulled from a Waterloo home as it burned. The children were rescued by firefighters using a ladder to enter the second story of the home. The children suffered from smoke inhalation and were treated at the University of Iowa Hospitals and Clinics. There is no mention of the fire's cause and origin or if smoke detectors were in working order. This is probably a good reminder to all of us to check batteries in our smoke detectors.
In Burlington, Iowa a corn snake called Naja has died after living 45 years. Naja was kept in a science class at Horace Mann Middle School. The science teacher, Joe Desy wrote an obituary for Naja and noted that it, he or she, you pick, lived in the classroom from 1972 until 2002 when the teacher retired. The Register noted, "Desy wrote in an obituary that Naja's early years were spent ridding Iowa farmlands of small rodents. At about the age of 8, the snake came to the school and was "resident reptile and teacher of all things good and true about snakes."
In Fairbanks, Iowa there was a fire on October 7th that caused a property loss at a manufacturing business. The investigation concluded that a 4-year-old boy playing with a "small torch" had been in a storage area getting firewood when the fire began.
And in Atlantic, Iowa a combine caught fire and a 59-year-old man, Mark Brown died. There are few details about how the fire started, why Mr. Brown wasn't able to get away or whether there was a malfunction of the engine. For those of you who don't know what a combine is, it's a large piece of farm machinery, which is driven in the fields and harvests corn, cotton and soybeans. Combines are extremely expensive pieces of machinery costing well over $100,000 to probably over $250,000. If you're interested in more you can visit John Deere University online. Having grown up in Rhode Island I have always been fascinated with farm machinery. I've never been able to figure out how to make money at it, but it's a fascinating profession.
A settlement is reported by the AP from a lawsuit for the wrongful death of a 13-year-old girl who fell about 100 feet to the ground from what appears to be the cage of a free-fall ride that took place in Lake Delton, Wisconsin on July 30, 2010. MIDWEST: Settlement Reached In Wisconsin Amusement Park Mishap A toddler is reported to have drowned in an ornamental pond in Fonda, Iowa.
Well, I’ve written about such an incident previously. Several years ago I wrote about a similar incident although I can’t recall if it was in Nebraska or Iowa. I believe it had to do with the sliding type of doors on a large farm machinery pole type of building. If I’m recalling the facts there was large gust of wind that knocked the door off its track, the door came lose, falling and killing the woman.

Actually I’ve had this question asked of me before and I was hoping to never see it again. But here it is staring me in the face once again. A power take-off (PTO) is a spined driveshaft, usually on a tractor or truck which can be used to provide power to an attachment or separate machine. It is designed to be easily connected and disconnected. The power take-off allows implements to draw energy from the tractor's engine.

When a pit bull attacks serious injury or death is certainly possible. In this dog attack the female pedestrian was jogging in the neighborhood. The dog owner owned three dogs and all three were put to sleep. Luckily a witness happened by and helped the female runner before it more damage. According to reports she was injured. Afterwards the animal control officer took possession of all three dogs and put them down. The witness is lucky he didn't have a heart attack.

In other personal injury news a 68-year-old Ryan man died after colliding with two locomotives at a private Canadian National Railroad crossing in northeast Iowa. He is Kenneth Elmer Sweet who lived in rural Iowa near Cedar Rapids in Delaware County. Interesting enough the Iowa Highway Patrol technical investigator is quoted as saying warning signs and flashing lights are not, the big N-O-T, required at private crossings and trains don’t have to sound their horns or whistles at private crossings. Wouldn’t it be nice if warning signs saying this is a private railroad crossing were posted? That way we’d know they weren’t going to warn us before mowing us down.
The City of Pella won its lawsuit against Central Electric, Co. but in this case, that win is going to prove to be very expensive. The Knoxville jury came back with an award of $788,000 for damages having to do with the breach of contract claim over the lights, wire and encasings.
