In Iowa what’s involved with investigating a roll-over accident?

These types of accidents can be a challenge to say the least. Probably more times than not they are a single car or truck accident; meaning there aren't two cars involved. That limits the focus to the one driver's actions and behavior. Again, more times than not alcohol is involved and if the passengers who seek the services of an attorney were out drinking with the driver there is the legal problem called complicity. Basically what the law says is that if you drank with the driver, or purchased him/her drinks and then knew the intoxicated state of that person, then the law isn't going to allow you to be rewarded with compensation.

That's a tough thing for many seriously injured passengers to get their brain wrapped around because it means they are without any avenue for a way to get their bills paid. I guess the lesson here is to not get into a car with someone that has been drinking. Call a cab or a relative to come pick you up.

But let's assume there's no alcohol involved or at least not enough to turn it into a drunk driving situation. Then the lawyer needs to focus on the driver's behavior and choices in driving that lead up to the rollover. We need to isolate the evidence that proves or disproves negligent driving.

  • Skid marks photographed.
  • Speed of the car or truck.
  • Tires tread depth.
  • Condition of the car or truck.
  • Condition of the road's surface.
  • Lay of the land.
  • Crest of a hill.
  • Road surface levelness.
  • Presence or absence of deer on the road.
  • Presence of absence of cows on the roadway.
  • Turning or heading straight.
  • Lookout of the driver.

When you're in one of these accidents get on it right away and take photographs and measure skid marks, digs, etc. Preserve the car or truck as much as you are able. Even if you have to purchase the scrap. Here is a little video series on how to measure skid marks. And don't get killed trying to measure the skid marks. Notice how this guy isn't one the road but he's still getting the length of the skid mark. Beyond that I don't think he knows what he's doing.
