Ice isn't an excuse for losing control and crossing the center line. Ice is a condition that occurs every year in Iowa. We expect the cold, we know it will snow and we also know that snow on warmer days will melt then turn to ice at night. So when someone points to the ice as if it were an excuse for a rollover that injured their passengers I have to just listen. Because it's really not a condition that excuses driving too fast, or being distracted with a cell phone or driving without due care for the weather conditions. Ice is ice and negligence is negligence. In the case below the driver lost control of the car (according to reports that could be wrong), then crossed the center line and hit a van driven by a 54-year-old man, Van Meeteren of Sioux Center. The way this system works, because Van Meeteren's vehicle was on the proper side of the road, and assuming he's free from fault, his insurance company will most likely pay and then seek recovery from the other driver, a woman that died in the crash. Her insurance will pay for the un-faulted driver's damages.
The passengers are sort of a different story. They may seek recovery from the Garrett auto insurance company, then Van Meeteren's under the underinsured motorist coverage and then from any auto insurance they have. Some people think this is too much but those are people standing on the sidelines who weren't hurt. This is a great country and we do save by buying and keeping insurance in place. That is a savings account that we bank on when someone causes us injury. In this case there may be no passengers, but I've included them for illustrative purposes and made the assumption there may have been. At this point, the accident was reported on the 17th of January and hopefully the those injured are beginning to mend.
