Minimal Reports

1.    A crash occurred in Calhoun County on January 22, 2015 – Essentially one driver pulled out from a stop sign right into the path of a car coming from his left. From what is reported the person with the right of way died. His estate would have a claim, although if additional facts come to light the assessment of fault could change. [I’m not sure why this January accident is just being reported in June or if the date entered is incorrect.]

Trooper’s Summary of the accident: VEH 1 WAS STOPPED AT A STOP SIGN AT THE INTERSECTION OF N65 AND HWY 20 EASTBOUND FACING NORTH, VEH 2 WAS EB ON HWY 20 IN THE PRIMARY LANE, VEH 1 ENTERED HWY 20 DIRECTLY IN THE PATH OF VEH 2, VEH 2 STRUCK VEH 1 IN THE DRIVERS SIDE DOOR, VEH 1 STOPPED IN THE MEDIAN FACING SOUTH, VEH 2 CONTINUED EB A SHORT DISTANCE, CROSSED THE MEDIAN AND WESTBOUND LANES AND ENTERED THE NORTH DITCH AND STOPPED IN AN OPEN FIELD.

2.    A crash occurred in Dickinson County on June 23, 2015 – In this accident a bicyclist appears to have been struck from behind by a Buick going in the same direction. There does not appear to be any mitigating factors in the ISP report. The driver of the car striking the bicycle was 23. The report is pretty cursory and tells us very little about fault. The best we can do with what is reported is consider a failure to use a proper lookout.

Trooper’s Summary of the accident: UNIT 1 WAS TRAVELING SOUTH IN THE OUTSIDE LANE ON HWY 71 SOUTH OF 34TH ST IN SPIRIT LAKE UNIT 2 -A BICYCLE- WAS ALSO TRAVELING SOUTH IN THE OUTSIDE LANE UNIT 2 WAS AHEAD OF UNIT 1 UNIT 1 STRUCK UNIT 2 FROM BEHIND-THE
DRIVERS NAME OF UNIT 2 IS BEING WITHHELD AT THIS TIME PENDING NOTIFICATION THIS ACCIDENT IS STILL UNDER INVESTIGATION AT THIS TIME.

3.    A crash occurred in Henry County on June 20, 2015 – This is a single vehicle accident involving a rollover. As reported below in the summary driver error, losing control, is the focus of the investigation and is reported as the cause. Apparently there were 4 passengers besides the driver. The driver was 15 and a youthful driver so inexperience is a likely cause. The other passengers were 10, 13, 15 and 17, all from Sioux Falls, South Dakota. 2004 Chrysler Town & Country. When I read about this type of an accident it is bothersome in that certain sensitivity must be employed by the lawyer as to how to settle the various claims. With the driver being so young the object should not be to cast such blame that she never gets over one mistake that led to a death. Yes, it was a bad mistake, but not one that should ruin a person’s life. Mistakes happen and negligence is not a blame game without consequences, but there is a limit to how long those consequences must be felt. In cases such as this one settling is the best avenue towards healing. The trooper’s report follows.
