Today we have eleven fatality reports to discuss; I’ll discuss them separately and one in a separate blog for the convenience of my readers. The following counties in Iowa are the scenes of these fatal accidents in which either the driver or a passenger died: Webster, Pottawattamie, Jefferson, Muscatine, Mills, Wapello, Mahaska, Iowa, Jackson, Ringgold and Delaware. This is a 14 day period starting on January 1, 2012. VEH 2 WAS STOPPED AT ENTRANCE TO CONVENIENCE STORE, VEH 1 EB ON HWY 175 DROPPED OFF ROADWAY OVER CORRECTED LOSING CONTROL AND SLID BROADSIDE INTO VEH 2, VEH 1 DRIVER DOOR CONNECTED WITH VEH 2 FRONT RIGHT CORNER, DRIVER 1 DIED AT THE HOSPITAL, DRIVER 2 TREATED AND RELEASED, STILL UNDER INVESTIGATION BY IOWA STATE PATROL, ASSISTED BY WEBSTER COUNTY SHERIFF DEPT, GOWRIE AND HARCOURT FIRE AND RESCUE AND TRINITY REGIONAL HOSPITAL... Edward Frazier of Gowrie and Shawn E. Morgan of Harcourt, Iowa involved. What appears to be the at-fault driver died.

VEHICLE 1 WAS WESTBOUND I80 FOR UNKNOWN REASON DRIVER OF VEHICLE 1 LOST CONTROL AND ENTERED THE MEDIAN AND ROTATED COUNTER CLOCKWISE AND CAME TO REST ON EASTBOUND LANES ON I80 WHERE IT WAS STRUCK TBONE STYLE ON DRIVERS SIDE BY VEHICLE 2 VEHICLE 1 CAME TO REST IN MEDIAN VEHICLE 2 CROSSED THE MEDIAN AND CAME TO REST WB LANE OF I80 STILL UNDER INVESTIGATION ... According to the Iowa State Patrol officer, the driver of the first vehicle, 22-year-old Nicolette M. Johnston from Harlan, lost control of her car on I-80 and the cost was her life. The report indicates the officer’s investigation concludes she lost control for no apparent reason, and then slid across the median and into opposing traffic where her car was struck by oncoming traffic, probably at highway speed and she was killed. The oncoming car was driven by Bret A. Roberts, 45 from Estherville, Iowa. Mr. Roberts was driving a semi-truck for Holiday Express Corporation out of Estherville.

VEHICLE WAS EASTBOUND HIGHWAY 34 VEHICLE LEFT ROADWAY AND ENTERED THE SOUTH DITCH INVESTIGATION CONTINUES ASSISTED BY JEFFERSON CO SO, JEFFERSON CO AMBULANCE, FAIRFIELD PD, AND LIBERTYVILLE FIRE AND RESCUE... In this car accident we have a single vehicle, single driver (Bradley Goodrich from Mt. Pleasant, Iowa, 31) driving on Highway 34, losing control, going into the ditch and from there it’s unclear whether he struck a culvert or flipped/rolled the Sebring he was driving. Nothing is clear from this report except that he died.

VEHICLE 1 WAS TRAVELING NORTHBOUND ON HWY 38 DRIVER 1 LOST CONTROL OF THE VEHICLE AND CROSSED THE CENTER LINE VEHICLE 1 WAS STRUCK BROADSIDE BY VEHICLE NUMBER 2 WHICH WAS TRAVELING SOUTHBOUND ON HWY 38 INVESTIGATION CONTINUES... We head over the Muscatine and Highway 38 at 7:55 a.m. for this fatality. It’s another loss of control accident, crossing the center line and getting hit broadside by oncoming traffic. Eighteen year old Krysten Reddick in a Cutlass Olds died – she crossed the center line. The other car is a 2003 Chrystler being driven by Robert Matthews of Wilton, Iowa. All of these losses of control cases involve speed, look out and probably distracted drivers. This is the type of case my firm working with another firm would handle, mainly for the passengers.

VEH 1 WAS EASTBOUND ON HWY 34 VEH 2 WESTBOUND ON HWY 34 BOTH VEHICLES COLLIDED NEAR CENTER PORTION OF THE ROAD, INVESTIGATION CONTINUING INTO WHICH VEHICLE LOST CONTROL BY THE IOWA STATE PATROL... This accident out of Mills County has no fewer than four people involved; two drivers and two passengers. Assuming one driver is at fault we can have up to three claims for insurance benefits. The accident location is on Highway 34, a place I’m familiar with. The time of the collision is 1700 hours, or 5:00 pm about 2 miles east of Malvern. Driving a 2003 Buick Randall Jones from Henderson (62) is heading east. In the opposing lane is Agustin Argueta (40) from Omaha, Nebraska. He’s heading west. I can tell from the way this preliminary report is written the officer isn’t entirely sure about what happened, who was at fault and who to charge. This investigation will have to continue and those accident scene photos and scuff marks on the pavement will be like tea leaves to a fortune teller. They will pinpoint the initial point of impact. (IPI) Randall Jones is shown on the report as having died and the other three were injured. They included Argueta the driver and his two passengers Hector Gimenez (21) and Rubin Antonio Soza Alvarez (28) both from Omaha. More than likely one lawyer cannot represent both the driver and the owner in the Argueta car. So long as the passengers weren’t drinking with the driver and didn’t do something in the car to make it go over the center line they should be without fault and not negligent. This is a case my firm would handle.

A VEHICLE TRAVELING SOUTH ON J45 FROM KELLERTON CAME UPON UNIT 1 IN THE DITCH. THE DRIVER OF UNIT 1 WAS PARTIALLY EJECTED FROM THE VEHICLE AND WAS DECEASED. THE ACCIDENT HAPPENED SOMETIME IN THE EARLY MORNING AS THE VEHICLE WAS COLD AND HAD FROST ON IT. THE DRIVER WAS THE ONLY PERSON IN THE VEHICLE AND NO OTHER CARS WHERE INVOLVED WITH UNIT 1. IT APPEARS THAT UNIT 1 WAS HEADING NORTH ON DJ WHEN THE DRIVER LOST CONTROL AND LEFT THE ROADWAY AND ENTERED THE WEST DITCH. THE VEHICLE THEN OVERTURNED AND CAME TO FINAL REST ON THE DRIVER'S SIDE OF THE TRUCK RESTING ON THE DRIVER. THE DRIVER WAS NOT WEARING A seat belt AND NUMEROUS CONTAINERS OF ALCOHOL WHERE FOUND IN AND AROUND UNIT 1. THE MEDICAL EXAMINER PRONOUNCED THE DRIVER TO BE DECEASED AND WAS TRANSPORTED TO RINGGOLD COUNTY HOSPITAL. UNIT ONE WAS TRAVELING EAST BOUND ON HWY 20 WHEN IT ENCOUNTERED UNIT TWO THAT WAS TRAVELING WEST BOUND IN THE EAST BOUND LANE. THE VEHICLES COLLIDED IN THE INSIDE LANE OF EAST BOUND HWY 20... This is a case that if the blood work comes back clean from the second car, driven by Daniel Nurre of Dyersville, Iowa then his estate should have no problem claiming fair compensation. I’m assuming the trucking company; Flying J Transportation out of Logan, Utah has high limits of insurance. I’ll cover this accident in a separate blog. The driver of the truck needs to explain why he was travelling in the east bound lanes while driving westerly. There is little left to do aside from interview the witnesses, photograph the truck and the Dodge and then deposing the driver. I’ll cover all of this in the other blog.
