Driver suffers a stroke, which is the definition of a real “accident”.

Most folks think of an accident as any collision that happens for any reason, but that’s not true. Driver fault is what causes collisions; driver error is what causes an accident as is the general description. But this crash is what I call a real “accident”. This driver suffered a stroke, blacked out and then is described as having run into the back of the Honda he was following. The driver who suffered the stroke was driving a Ford pickup truck.

This is interesting because these two drivers are on the Interstate, I-35, and the one suffers a medical condition, a stroke, then runs into the rear of the truck in front. There is no actionable negligence, all there is a collision of no one's fault. Now the guy who gets run into may have a workers' compensation claim, but that's another story.

The officer’s report describes the sequence as follows: VEHICLE 1 WAS NORTHBOUND ON I-35, IN THE RIGHT LANE, WHEN IT WAS STRUCK FROM BEHIND BY VEHICLE 2. VEHICLE 2 WAS ALSO NORTHBOUND ON I-35 IN THE RIGHT LANE, WHEN THE DRIVER OF VEHICLE 2 SUFFERED A STROKE, BLACKED OUT AND STRUCK VEHICLE 1.

After a worker is injured is when they need the support of their employer the most. But injured workers aren't given a level playing field. The worker is left alone to fend for themselves and to make mistakes that result in lower benefits or fewer weeks of benefits. Some are sent back to work too soon. There is only one person on your side and that understands this system.
