Oh my gosh, what a mess this one is. In this car accident we have the first guy going over the center line and crashing into a second car. A third car following is described as following the second car and narrowly misses crashing into the two cars by going in between them. This third car then ends up in the ditch and rolling over.
The first vehicle is an F-250 so it's going to cause a lot of damage to the second one, a 1995 Chevy Blazer SUV. The third vehicle is a Toyota HIG SW whatever that is, I don't know. This is in Jones County, east of Cedar Rapids and west of Dubuque. The fatality occurs in the second car. A 4-year-old child was fatally injured. I'd say the driver of the first vehicle has a lot of explaining to do about why the truck came across the center line. If there was a cell phone distraction that interfered with his driving punitive damages may be in order. Digital distractions are a basis for a gross negligence claim. I have to think the judges in Iowa and across the nation are getting sick and tired of having their dockets filled with car accidents caused by cell phone distracted drivers. UNIT #1 WAS EASTBOUND ON E-28 AND WAS NEGOTIATING THROUGH A LEFT HAND CURVE. UNIT #1 CROSSED THE CENTER LINE AND STRUCK WESTBOUND UNIT #2 ALMOST HEAD ON. AFTER IMPACT UNIT #1 CAME TO REST PARTIALLY ON THE TRAVELED PORTION OF THE ROADWAY. AFTER IMPACT UNIT #2 ENTERED THE NORTH DITCH AND CAME TO REST FACING IN A SOUTHERLY DIRECTION. UNIT #3 WAS FOLLOWING UNIT #2. AFTER SEEING THE IMPACT HAPPEN THE DRIVER OF UNIT #3 WENT BETWEEN VEH. #1 & #2 AFTER THEY SEPARATED AND ENTERED THE DITCH AT WHICH TIME IT STARTED ROLLING OVER. UNIT #3 CAME TO REST IN THE NORTH DITCH ON IT'S SIDE....
