Clear indication of negligence in Roseville’s woman’s motorcycle accident

The news item has a woman from Roseville riding her 1993 Honda motorcycle west on Highway 18 at about 9:40 a.m. A semi truck driver, Brian Hanley, 43 of Buda, Illinois crosses the center line causing Diane Mackenzie, 56 to maneuver to avoid hitting him; she losses control goes off onto the shoulder and when coming back onto the road losses control, crashes and is killed.

If you come across the center line you'd better have a good reason. In this instance none is given.

If you look at what occurred after she came back onto the roadway it gets very messy. It appears two other trucks, one driven by Loran Shetler and the other by Jerry Freeman ended up colliding with the Mackenzie motorcycle.

Original article by Peggy Senzario of the News-Tribune. Accident investigated bby the Iowa State Patrol, the Garner Police and Fire Department, the Hancock County Sheriff's Office and the Iowa DOT.

FAQs

ATV, Bike & Motorcycle Accidents

Is there anything I can do to settle my health problems after an accident? Hit by car on bike, no treatment, and no police. Now shoulder hurts any recourse? This is not a hit and run, he paid for the damage to my bike, and I agreed he could do it out of pocket because it was less than his deductible and I thought I was fine. That night he gave me a ride home and did admit he did not look my way. He also loaned me a wheel for my bike which I did not use. He paid me with a check for the damage. I have pictures of my bike and his truck (license plate yes but a bit fuzzy) from the night. I have his name, address, phone number, and place of employment, and receipts from my bike repair. I will feel bad about renegotiating our agreement but my health is at stake. Is there anything I can do?

How do I file a claim after being in an accident? My husband was a cyclist and was hit by a car. How do I start a claim against the person who hit him?
