Clear case of negligence – running a stop sign

November 2, 2010 - The Iowa State Patrol has a crash report of a fatal accident in Audubon County involving a 64-year-old man driving a 2006 Chevy Silverado pickup truck allegedly runs a stop sign at County Road M66 and F24. Unfortunately for him a semi-truck was heading west on F24 was coming along and the two trucks collided killing the driver that is said to have run the stop sign. The driver of the Freightliner, Marvin Pudenz isn't reported to have been injured.

Negligence is a two-way street and comparative fault in this case killed one of the drivers. This is a case of a failure to driver using due care and to follow the rules of the road; a stop sign.

UNIT 2 WAS SB ON CO RD M66, RAN STOP SIGN WHERE UNIT 1, WHICH WAS WB ON F24, COLLIDED WITH UNIT 2 AT INTERSECTION UNIT 1 ENDED UP IN S DITCH, UNIT 2 ENDED UP IN N DITCH WHERE IT IGNITED INTO FLAMES DRIVER OF UNIT 1 WAS UNINJURED, DRIVER OF UNIT 2 WAS PRONOUNCED DEAD AT THE SCENE UNKNOWN IF DRIVER 2 WAS WEARING SEATBELT

The next crash report we have is out of Des Moines County on October 30, 2010. This is somewhat of an odd case. A 68-year-old man is described as sitting in a chair in the back of a 2008 Ford F250 pickup truck that is backing down an alley at an auction. The report has the driver as a Paul Smith and the 68-year-old man in the rear of the bed is one Danny Smith. For whatever reasons the man in the truck bed fell out and although it doesn't say what actually happened he must have gotten run over and was killed. Very odd as the report describes the incident and provides very sketchy details.

NARRATIVE: PAUL WAS BACKING THE PICK-UP DOWN AN ALLEY AT AN AUCTION DANNY WAS SITTING IN A CHAIR IN THE BACK AND FELL OUT ASSISTED BY: BURLINGTON POLICE DEPARTMENT BURLINGTON AMBULANCE

The last report is out of Hamilton County and occurred on November 1, 2010 at around 3:15 pm. at the intersection of 1697 - 210th Street and 210th Street in Hamilton County. The report describes the driver of the first car, a 75-year-old man driving a 1997 Chrysler CNC as "heavily medicated" and failing to yield while attempting to turn left of center in what appears to be a driveway. (This could be described as a case of driving while under the influence; it's not always alcohol that is the influence.) The driver of the other car, a 2004 Dodge was injured in what appears to be a head-on collision and taken to Van Diest Medical Center by ambulance. He is Bronson Andrew, a 28-year-old man from Fort Dodge, Iowa. Officer Saldivar describes the sequence in his narrative as follows:

UNIT ONE TRAVELING EAST BOUND MAKING A LEFT TURN NORTH STRUCK VEHICLE 2 MOVING WEST BOUND DRIVER UNIT 1 CONDITION HEAVILY MEDICATED
