Can an assault at the grocery store be the basis of a workers’ compensation claim?

Yes, this report of four Dahl employees being injured in a fight resulted in criminal charges against two females. See the KCCI story 4 Workers Hurt In Grocery Store Fight, dated February 6, 2012 with mug shots and a photo of the store. Workers in furthering the employees business are covered under workers’ compensation. It’s no different than being held up like some motel night clerks have been. One we represented was shot in the leg by the robber. He was paid. Tom Wertz over in Cedar Rapids represented another suffering from PTSD after being held up. Even though it’s criminal activity it’s still a valid and compensable injury.

What else are we seeing in recent news stories about workers’ compensation claims. Well there is the construction worker from Tama who suffered a head injury, (additional link to Benda Ag worker injury) there is the backhoe operator accident near Crescent, Iowa who ended up trapped in the water filled cab and a fellow worker had to break the glass to rescue him (great job!) The photo is pretty interesting to see it stuck in the mud. Worker comp claims are complex to pursue without having a lawyer. It’s that simple. The insurance adjusters are not on your side, even when they are friendly they are not your friend. So don’t forget it.
