Iowa Car Accidents for mid-February 2011

A driver lost control of her vehicle on the Cedar River bridge west-bound on Highway 30, entered a ditch, and hit a tree on Saturday morning, authorities say. Emergency crews responded just before 7 a.m. on Saturday. The driver, Hannah Hall, 17, of Cedar Rapids, was transported to Mercy Medical Center in Cedar Rapids for non-life threatening injuries, according to a report from the Linn County Sheriff’s office.

Roll-Over Accidents May Allow a Passenger Claim for Personal Injury

I see a lot of these accident reports in Iowa; perhaps it has to do with driving SUV’s with a high center of gravity, flat roads allowing faster speeds and the allusion of being in control along with driving too fast from being in too much of a hurry. I don’t know but what I do know is that passengers have a claim against the driver for not driving with due care, failing to maintain a proper lookout and for failing to drive with due care.

Driving distracted kills driver and injures passengers

On October 4th 2009 James Godwin of Jefferson, Iowa failed to stop, running the stop sign and straight into the car driven by Bart Baugh of Churdan. Mr. Godwin was pronounced dead at the scene and all four people in the Baugh car; Bart Baugh, Trevor Baugh, Taryn Baugh, and Torey Baugh, were injured and taken by ambulance to the hospital. This accident occurred in Greene County, Iowa at the intersection of Highway 4 and Highway E26.

There are hundreds of mva's just like this one that occur every week in Iowa. I see no days when there aren't any accidents that cause injuries and deaths. What was the distraction? Why didn’t the car stop and yield the right of way? You can’t complain about the number of lawsuits being filed when distracted drivers cause so many injuries and deaths. And don't blame the lawyers. If you do it’s the same as blaming doctors for cancer. Blaming the legal profession is a foolish and naive point-of-view. And it's one that allows the responsible party to avoid being responsible.

When you drive pay attention to your driving. Put the cell phones away. Stop looking at whatever digital device is the latest craze. Simply put, drive.

Driver Safety: Albia, Iowa collision "caused by snow and ice?"

Many know how headlines like this drive me crazy because of how misleading they can be. Snow and ice don’t cause accidents; drivers do. Drivers who fail to slow down and drive according to the conditions and how that affects maintaining control of their car, truck or motorcycle.

So when a crash occurs like the one reported from Albia, Iowa where a 19-year-old Zach Murray is killed by the car he’s a passenger in, sliding sideways, crossing the center line and crashing into the oncoming Melissa Thompson from Ft. Leavenworth, Kansas; it isn’t the snow and ice that get blamed but the driver who was probably driving too fast for the conditions.  In this case more than likely Thompson and the Estate of Zachary Murray will have claims against the driver, Palen. Hopefully she has insurance to cover their damages.

This Ottumwa Courier and I have gone round and round about other litigation. How about getting the facts right?
