Death by Golfball - yell Fore!!!

I saw an interesting story about getting hit by a golf ball and the death rate. In Death by golf ball not all that uncommon by Bart Pfankuch he examines a several incidents where the decedent was struck by a golf ball and died. His point is to remember there is a reason you’re supposed to yell “fore!” before every shot. The article discusses seven incidents where a person was hit by a golf ball and suffered a serious injury resulting in death. Sport Injury: Softball bat strikes player in the head.

This case is interesting in that it demonstrates the difficulty of pursing a lawsuit stemming from injury while playing a sport; in this case the sport is softball. A player was struck in the head during batting practice. The batter let the bat fly after hitting the ball and it struck another player. While that’s not something players want to happen it does and they know it, so it’s in many ways foreseeable. Iowa law is tough in this area and requires the act that led to the injury to be intentional or reckless. The Iowa Supreme Court took up the matter and sent the case back for a trial and for the jury to decide if the batters actions were either intentional or reckless.

Practice Tip: If you’re client has suffered a TBI or head injury have the hearing checked. Tough part is establishing a baseline to establish a foundation or basis for the loss and right to receive compensation. So first things first; in the initial interview watch for the signs of a hearing loss and ask if they’ve noticed any changes in hearing. Ask the spouse if they are asking for people to repeat themselves. Most patients won’t tell the doctor who is treating the head injury; most will chalk it up to just old age.

I-380 Iowa Motorcycle Crash, No Helmets

On Saturday June 20th, at 10:15pm, a motorcycle driving northbound on I-380 near Center Point, crashed into a deer, according to the Des Moines Register. The 23-year-old driver Donald Bruce was transported to University of Iowa Hospitals, and his passenger, also 23, Elexia Turk, died at the scene from severe head injuries. Both were not wearing helmets. They were from Cedar Rapids.

I-35 Texas Car Accident Involves a Cyclone and a Hawkeye Football Player

David Cato, 19 who plays defensive back for the Iowa Hawkeyes and Ter’ran Denton, (sic) 19 a defensive back from the Iowa State Cyclones were driving on I-35 south of Purcell at 10:00 a.m. on a Sunday when the car they were in rolled after coming in contact with a semi-truck. According to the news report the trooper has the 18-wheeler being nudged before rolling and striking the embankment on the west side of the Interstate Highway.

Des Moines Police Searching for Location of Brain Injured Man

He has a brain injury and from what the reports state he is easily confused. Norris Price walked away from a local area hospital on Saturday around 12:30 p.m. He’s 6’4”, weighs 224 pounds and is 52 years old. When he walked off he was wearing a white t-shirt and blue or gray baggy pants. He may have on a brown beanie style hat with Harley Davidson on it.

 

He likes restaurants and bars, where he apparently likes to hang out.

 

Those with information about Price’s whereabouts are asked to contact the Des Moines Police Department at 283-4811.

 

Person’s who have suffered traumatic brain injury have problems with executive brain function; they have difficulty ordering things in their brain so they are easily confused and have difficulties staying on track. Their marriages usually break up; they lose their job and most everything else in their lives. They are difficult to take care of and often times are a danger to themselves. And that is why I recommend wearing your helmet while riding a motorcycle.

 

A search of the Iowa Industrial Commission decisions did not turn up any case involving Mr. Price or Schumacher Elevator Company. A search of Iowa Court’s online turned up a person with the same name and showed a Petition being filed on November 24, 2003 against SCHUMACHER ELEVATOR CO. and being dismissed on January 24, 2006. There is a Schumacher Elevator Company in Denver, Iowa.  In the Court filings was a waiver of a workers’ compensation lien being filed on February 25, 2005 by “ORHC and Cannon Cochran Management Services, Inc.” ORHC is Ottumwa Regional Health Center and Cannon Cochran is what we call a TPA, or third party administrator.  Under Iowa law workers’ compensation insurers have a lien against third party settlements or funds generated from civil lawsuits outside of the workers’ compensation system.  This may or may not be the same person, but it certainly has a similar profile to what I’d expect to see if there was an accidental injury involving work and a third party. What is more important to this situation is how it demonstrates the need for caution when it comes to protecting your brain.

 

I was walking last week at Raccoon River Complex in West Des Moines and a high school age young lady was riding a moped, with no helmet while texting someone on her cell phone. She wore flip flops and a skirt. That is not too smart a move on her part.

 

Like I said, wear your helmet and if you have information concerning Mr. Price call the Des Moines Police.
