5 Mistakes Injured People Make in a Brain Damage Accident Case

People who are struck and injured in the area of their skull can suffer traumatic brain injury, or as we say a TBI. Motorcycle riders are notorious for suffering TBI's. Pedestrians, ATV riders, moped riders, skateboarders, ironworkers and truck drivers all engage in activities considered high-risk for suffering a TBI. I have handled these cases for a long-long time. My undergraduate degree is in psychology and we studied the brain in detail so it obviously intrigues me.

These are interesting cases to litigate and can have enormous monetary effects on a family because of the lasting effects a brain injury is likely to cause. These cases can be the saddest for everyone involved. Sometimes the amount of insurance coverage does not even come close to covering all of the economic losses. Any wife whose breadwinning husband has a brain injury with cognitive deficits knows what I am talking about. The breadwinner soon loses all their friends, their job, their income and all the benefits the family once enjoyed. Now left with no other alternative the wife applies for social security disability benefits and finds out what it means to be poor in the worst way. No longer able to leave the husband alone she cannot work and tries unsuccessfully to live on around $1,500 per month in disability benefits. Try feeding a family of four or more on $1,500 a month. It isn’t too long before the family home has to be sold, the expensive cars traded away and eating out is swapped for canned beans and a bag of frozen French fries. The kids dreams of a college education turn to one of work and economic struggle. The days become weeks, the weeks become months and the months turn into years of a desperate struggle. Somewhere down the road seeing a lawyer starts to creep into the recesses of the wife’s mind and sometime later she sits across from me asking what can be done.

Sometimes there is much I can do. So how about we start this list of five off with the most important.

Hire a lawyer right after the accident. I mean right after, like the day of or the next day.

Why? Because there is so much to do in the investigation that to waste your time listing four more failures would be a waste of your time and mine.

  1. Hire a lawyer right after the accident. I mean right after, like the day of or the next day. Take pictures of the head trauma.
